Pour faciliter la lutte contre la fraude, la corruption et les autres actes illégaux en vertu du règlement (CE) no 1073/1999, l'Agence adhère, au plus tard le 16 décembre 2016, à l'accord interinstitutionnel du 25 mai 1999 relatif aux enquêtes internes effectuées par l'OLAF et arrête les dispositions appropriées, qui s'appliquent à tout le personnel de l'Agence, en utilisant le modèle figurant en annexe dudit accord interinstitutionnel.

In order to facilitate the fight against fraud, corruption and other unlawful activities under Regulation (EC) No 1073/1999, the Agency shall by 16 December 2016 accede to the Inter-institutional Agreement of 25 May 1999 concerning internal investigations by OLAF and adopt the appropriate provisions applicable to all employees of the Agency, using the template set out in the Annex to that Agreement.

The model decision attached to the Interinstitutional Agreement of 25 May 1999 between the European Parliament, the Council and the Commission, and, as regards Commission officials, Decision 1999/396, both of which concern the terms and conditions for internal investigations in relation to the prevention of fraud, corruption and any illegal activity detrimental to the Communities’ interests, merely require, in the second paragraph of Article 4, that the Secretary-General of the institution must agree that the obligation to invite the person concerned to give his views may be deferred where the needs of the investigation require.
