TRADUCTIONS EN CONTEXTE

L’article 6, point 1, du règlement no 44/2001 doit être interprété en ce sens qu’il n’a pas vocation à s’appliquer à des défendeurs qui ne sont pas domiciliés sur le territoire d’un État membre lorsque ceux-ci sont assignés dans le cadre d’une action intentée contre plusieurs défendeurs parmi lesquels se trouvent également des personnes domiciliées dans l’Union européenne.
Article 6(1) of Regulation No 44/2001 must be interpreted as meaning that it is not intended to apply to defendants who are not domiciled in another Member State, in the case where they are sued in proceedings brought against several defendants, some of who are also persons domiciled in the European Union.

2. Lorsqu'une action visée au paragraphe 1 est liée à une action en matière civile et commerciale intentée contre le même défendeur, le praticien de l'insolvabilité peut porter les deux actions devant les juridictions de l'État membre sur le territoire duquel le défendeur est domicilié ou, si l'action est dirigée contre plusieurs défendeurs, devant les juridictions de l'État membre sur le territoire duquel l'un d'eux est domicilié, à condition que ces juridictions soient compétentes en vertu du règlement (UE) no 1215/2012.

Where an action referred to in paragraph 1 is related to an action in civil and commercial matters against the same defendant, the insolvency practitioner may bring both actions before the courts of the Member State within the territory of which the defendant is domiciled, or, where the action is brought against several defendants, before the courts of the Member State within the territory of which any of them is domiciled, provided that those courts have jurisdiction pursuant to Regulation (EU) No 1215/2012.

When the market is, or is likely to be, affected in more than one country, the person seeking compensation for damage who sues in the court of the domicile of the defendant, may instead choose to base his or her claim on the law of the court seised, provided that the market in that Member State is amongst those directly and substantially affected by the restriction of competition out of which the non-contractual obligation on which the claim is based arises; where the claimant sues, in accordance with the applicable rules on jurisdiction, more than one defendant in that court, he or she can only choose to base his or her claim on the law of that court if the restriction of competition on which the claim against each of these defendants relies directly and substantially affects also the market in the Member State of that court.
