D. whereas in order to enhance the existing measures such as the Convention on the Protection of the Communities’ Financial Interests (PIF Convention) for fighting fraud, corruption, money laundering and other illegal activities affecting the financial interests of the Union, the Commission has submitted two proposals for criminal law instruments, the PIF Directive and the Regulation on the establishment of the European Public Prosecutor’s Office (EPPO Regulation), aimed at ensuring more effective investigation and better protection of the taxpayers’ money throughout the European Area of Freedom, Security and Justice;

Selon cette interprétation, on a inséré dans la directive quasi toutes les normes et dispositions déjà contenues dans les instruments PIF inefficaces, à l'exception de celles qui relèvent strictement des instruments du troisième pilier et qui pourront être mises en œuvre avec la ratification des instruments PIF et leur reprise dans une décision cadre.
In accordance with this interpretation, the Directive incorporates almost all the rules and provisions already contained in the ineffective PFI instruments, except those which are strictly relevant to third-pillar instruments and which may be implemented by means of the ratification of the PFI instruments or their incorporation in a framework decision.

La directive, instrument choisi par la Commission, apparaît effectivement le plus adéquat et ne devrait pas poser de problèmes de transposition, en particulier pour les États membres qui ont déjà souscrit aux instruments PIF.
A directive (the instrument chosen by the Commission) appears to be the most suitable tool and should not pose any transposition problems, at least not in the case of the Member States which have already adopted the PFI instruments.

The Commission takes the view that the last part of paragraph 4 'These measures shall not concern the application of national criminal law or the national administration of justice' refers to procedural criminal law and to cooperation between judicial authorities and, hence, makes it possible to incorporate in a directive (first-pillar), all the rules and provisions contained in the above-mentioned PFI concerning substantive criminal law and cooperation between the national judicial authorities and the European Commission.

Given the extent of international economic and financial crime and the damage it does to the EU's financial interests, the unacceptable lack of progress due to incomplete ratification of the PFI instruments calls for the current legal arrangements to be given more teeth as a matter of urgency, by using, the new legal basis [Article 280(4) of the EC Treaty ], which was introduced by the Amsterdam Treaty and entered into force after the adoption of the PFI instruments.

The first instruments adopted for the protection of the Community's financial interests were under Title VI of the EU Treaty ("the Third Pillar"), namely the Convention of 1995 and the additional protocols signed in 1996 and 1997 on the protection of the European Communities' financial interests (the PFI instruments), but these have not been ratified by all the Member States, despite repeated calls not just from the Commission, but also from the Council and the European Parliament (see Annex)
