In particular, actions will have to comply with the provisions of the Charter of Fundamental Rights of the European Union, European data protection rules, the European Convention for the Protection of Human Rights and Fundamental Freedoms (ECHR), the fair treatment of third country nationals, the right of asylum and international protection, the principle of non-refoulement and the international obligations of the Union and Member States arising from the international instruments, for example the Geneva Convention Relating to the Status of Refugees of 28 July 1951, as supplemented by the New York Protocol of 31 January 1967 (“the Geneva Convention”), to which they are signatory.

In realising this objective it is necessary to ensure respect for fundamental rights (Article 67(1) of the TFEU) and human dignity in accordance with the provisions of the Charter of Fundamental Rights of the European Union and the European Convention for the Protection of Human Rights and Fundamental Freedoms (ECHR) and, concerning the development of a common asylum, immigration and external border control policy, the fair treatment of third country nationals (Article 67(2) of the TFEU), respect for their right of asylum and international protection, the principle of non-refoulement and sea rescue of migrants and compliance with the international obligations of the Union and Member States arising from the international instruments, for example the Geneva Convention Relating to the Status of Refugees of 28 July 1951, as supplemented by the New York Protocol of 31 January 1967 (‘the Geneva Convention’), to which they are signatory .

2. Les parties conviennent de mettre en œuvre leurs engagements respectifs visant à lutter contre le commerce illégal des armes légères et de petit calibre, y compris de leurs munitions, dans le cadre d'instruments internationaux, notamment du programme d'action des Nations unies en vue de prévenir, de combattre et d'éliminer le commerce illicite des armes légères sous toutes ses formes, de l'instrument international visant à permettre aux États de procéder à l'identification et au traçage rapides et fiables des armes légères et de petit calibre illicites ainsi que des obligations découlant des résolutions du Conseil de sécurité des Nations unies.
2. The Parties agree to implement their respective commitments to deal with the illicit trade in small arms and light weapons, including their ammunition, within the framework of international instruments including the UN Programme of Action to Prevent, Combat and Eradicate the Illicit Trade in Small Arms and Light Weapons in All Its Aspects (UN PoA) and the International Instrument to Enable States to Identify and Trace, in a Timely and Reliable Manner, Illicit Small Arms and Light Weapons (ITI) as well as obligations deriving from UN Security Council resolutions.

10. Aucune disposition du présent Code ne doit être interprétée ou appliquée d'une manière incompatible avec le respect voulu des libertés et droits fondamentaux énoncés dans les instruments internationaux, notamment ceux qui ont trait aux travailleurs maritimes et aux réfugiés, y compris la Déclaration de l'Organisation internationale du Travail sur les principes fondamentaux et les droits au travail, ainsi que les normes internationales concernant les travailleurs maritimes et portuaires.
10. Nothing in this Code shall be interpreted or applied in a manner inconsistent with the proper respect of fundamental rights and freedoms as set out in international instruments, particularly those relating to maritime workers and refugees, including the International Labour Organisation Declaration of Fundamental Principles and Rights at Work as well as international standards concerning maritime and port workers.

CEPOL's main objectives and tasks are to increase knowledge of the national police systems and structures of other Member States, of Europol and of cross-border police co-operation within the European Union; to strengthen knowledge of international instruments, in particular those which already exist at European Union level in the field of co-operation on combating crime; to provide appropriate training with regard to respect for democratic safeguards with particular reference to the rights of defence; and to encourage co-operation with other police training institutes.
