Article 54(1) and (2) of Directive 2004/39/EC of the European Parliament and of the Council of 21 April 2004 on markets in financial instruments amending Council Directives 85/611/EEC and 93/6/EEC and Directive 2000/12/EC of the European Parliament and of the Council and repealing Council Directive 93/22/EEC must be interpreted as meaning that, in administrative proceedings, a national supervisory authority may rely on the obligation to maintain professional secrecy against a person who, in a case not covered by criminal law and not in a civil or commercial proceeding, requests it to grant access to information concerning an investment firm which is in judicial liquidation, even where that firm’s main business model consisted in large scale fraud and wilful harming of investors’ interests and several executives of that firm have been sentenced to terms of imprisonment.

2.5.3. The Commission will call on customs administrations to create the conditions for pursuing dialogue at national level, in the first instance, for example, by means of a special hot-line which would allow feedback to be collected centrally and channelled to the relevant authorities, or by appointing customs ombudsmen in charge of receiving and dealing with complaints from operators about unfair or unsatisfactory treatment without recourse to the courts, with a view to improving service and raising standards of performance. Je ne connais pas d'autre façon d'aborder ces questions. En fin de compte, les gouvernements font appel à de nouveaux instruments et il faut bien dire que, pour participer au dialogue, un peu de connaissance du jargon ne fait pas de tort. Les gouvernements et les bureaucrates auraient peut-être intérêt à en utiliser moins et certains autres intervenants auraient intérêt à en connaître davantage.
The bottom line is governments do use new tools, and I think to be part of that dialogue you have to get a bit into the jargon, and maybe governments and bureaucrats will use less of it and on the other hand others will become more familiar with it.
