‘regulated market’ means a multilateral system operated and/or managed by a market operator, which brings together or facilitates the bringing together of multiple third-party buying and selling interests in financial instruments – in the system and in accordance with its non-discretionary rules – in a way that results in a contract, in respect of the financial instruments admitted to trading under its rules and/or systems, and which is authorised and functions regularly and in accordance with Title III of this Directive;

1. Pour tout instrument financier admis à la négociation sur un marché réglementé ou un MTF, l'autorité compétente de l'État membre pour la plate-forme de négociation où l'instrument financier a été admis en premier lieu à la négociation est habilitée à exercer une surveillance de marché à marché en vue de détecter les manipulations de marché commises par l'intermédiaire des carnets d'ordres.
1. For any financial instrument admitted to trading on a regulated market or an MTF, the competent authority of the Member State concerning the trading venue where the financial instrument was first admitted to trading shall have the power to conduct cross-market supervision of market manipulation conducted through order-book activity.

178. 2. The obligation laid down in paragraph 1 shall not apply to financial instruments which are not admitted to trading or traded on an MTF or an OTF, to financial instruments whose value does not depend on that of a financial instrument admitted to trading or traded on an MTF or an OTF, nor to financial instruments which do not or are not likely to have an effect on a financial instrument admitted to trading or traded on an MTF or an OTF.

Les seuls instruments qui échapperont à cette obligation seront (i) les instruments qui ne sont ni admis à la négociation ni négociés sur un MTF ou un OTF, (ii) les instruments dont la valeur ne dépend pas de celle d'un instrument financier admis à la négociation ou négocié sur un MTF ou un OTF, (iii) les instruments dont la négociation ne peut pas avoir d'incidence sur un instrument admis à la négociation ou négocié sur un MTF ou un OTF.
The only instruments escaping the requirement will be (i) the instruments not admitted to trading nor traded on an MTF or OTF, (ii) the instruments whose value does not depend on that of a financial instrument admitted to trading or traded on an MTF or OTF, (iii) the instruments the trading of which cannot have an impact on an instrument admitted to trading nor traded on an MTF or OTF.
