D. considérant que les évènements qu'a connus la Hongrie ces dernières années et que les actions et les mesures prises dans le pays ont provoqué une grave détérioration de la situation en ce qui concerne notamment la liberté et le pluralisme des médias, la lutte contre l'intolérance et les discriminations, les droits fondamentaux des migrants, des demandeurs d'asile et des réfugiés, la liberté de réunion et d'association, la liberté de l'éducation et de la recherche universitaire, l'égalité de traitement des religions et des croyances, les activités des organisations de la société civile qui ont fait l'objet de restrictions et d'obstructions, les droits des personnes appartenant aux minorités, y compris les Roms et les personnes LGBTI, le fonctionnement du système constitutionnel, l'indépendance du pouvoir judiciaire et des diverses institutions censées exercer un pouvoir de contrôle de balancier dans un régime démocratique, sans oublier les nombreux soupçons inquiétants de corruption, qui compromettent l'état de droit;
D. whereas recent developments and initiatives and measures taken over the past few years in Hungary have led to a serious deterioration in the situation as regards, inter alia, media freedom and pluralism, the fight against intolerance and discrimination, the human rights of migrants, asylum seekers and refugees, freedom of assembly and association, freedom of education and academic research, the right to equal treatment on grounds of religion and belief, the ability of civil society organisations to perform their role without hindrance and without having their rights restricted, the rights of people belonging to minorities, including Roma and LGBTI people, the functioning of the constitutional system, the independence of the judiciary and of other institutions that should act as checks and balances in a democratic state and many worrying allegations of corruption and conflicts of interest undermining the rule of law;

There is no breach of the principle of equal treatment where a vacancy notice published by an EU body provides, first, that if the post is filled by an official he will retain his grade and, second, that if it is filled by secondment of a member of staff of a Member State’s diplomatic service he will be recruited as a member of the temporary staff in grade AD 5, which has the effect of preventing the latter from asserting his seniority, in so far as EU officials and staff of the Member States’ national diplomatic services who are seconded to an EU institution or body are not in an identical or a similar situation as regards the framework within which their career is supposed to progress, or indeed the way in which their administration of origin assesses their seniority.

Considers, in particular, that the increases in the standard abatement rates, meant to increase the number of unpaid posts within the institutions, reflect a conservative approach which will directly affect the possibility to improve occupancy rates of the establishment plans that are at the same time being approved by the budget authority; emphasises that such an approach is all the more detrimental in a context of reduction of establishment plans, which mechanically improves occupancy rates, and that the financing of these posts should not be considered as an adjustment variable for achieving a nominal freeze of administrative budget or any other predefined target amount;

It is incomprehensible that the institution supposed to be at the centre of power in the Community should continue to deliberate in a room in which 85 people (in a Community of 15 members) are sitting round a table, and behind each delegation, including the Presidency and Commission, there are half a dozen seats and a constant to-ing and fro-ing of national and Community staff.
