Where a person is entitled to benefits under the legislation applied by the institution to which the declaration or notification was sent, that institution shall make the advance payments, the amount of which shall be determined, where appropriate, after consulting the institution which made the decision against which the appeal was lodged, and in such a way that overpayments are avoided.

Si l’institution à laquelle la demande a été transmise ne prend pas position dans un délai de deux mois suivant la réception de la demande, la décision provisoire visée plus haut s’applique et l’institution verse les prestations prévues au titre de sa législation et informe l’institution à laquelle la demande a été faite du montant des prestations versées.

Where there is a difference of views between the institutions or authorities of two or more Member States about which institution should provide the benefits in cash or in kind, the person concerned who could claim benefits if there was no dispute shall be entitled, on a provisional basis, to the benefits provided for by the legislation applied by the institution of his place of residence or, if that person does not reside on the territory of one of the Member States concerned, to the benefits provided for by the legislation applied by the institution to which the request was first submitted.

The cost of benefits with which a pensioner who is a former frontier worker or the survivor of a frontier worker is provided under Article 27, and the cost of benefits with which members of his family are provided under Article 27 or 31 shall, where the frontier worker was working as such for the three months immediately preceding the date on which the pension became payable on the date of his death, be divided equally between the institution of the pensioner's place of residence and that with which he was last insured.
