The regulatory body for the rail sector may also be joined in organisational term with the national competition authority referred to in Article 11 of Council Regulation (EC) No 1/2003 of 16 December 2002 on the implementation of the rules on competition laid down in Articles 101 and 102 of the Treaty , the safety authority established under Directive 2004/49/EC of the European Parliament and of the Council of 29 April 2004 on safety on the Community's railways or the licensing authority referred to in Chapter III of this Directive, if the joint body fulfils the independence requirements set out in paragraph 1 of this Article.

Is deeply concerned that, under the new working method, which provides for complaints received by the Commission to be referred back to the Member State concerned (which is the party responsible for the incorrect application of Community law in the first place), the Commission may be failing to meet its institutional responsibility for ensuring the application of Community law as 'guardian of the treaties', in accordance with Article 211 of the EC Treaty; notes that the Commission is frequently the only remaining body to which citizens can turn to complain about the failure to apply Community law; urges the Commission to submit to Parliament a first report by November 2008 on the procedures followed and results obtained during the first six months of the pilot project which commenced on 15 April 2008 and which involves 15 Member States;

Nous proposerons que les États membres établissent des programmes d’action, nationaux, qui mériteraient d’être conçus de concert avec les partenaires sociaux et qui devraient être présentés aux parlements nationaux, qui, avec les instances communautaires, surveilleraient leur mise en application.
We are proposing that Member States should set up action programmes at national level. These should be designed in conjunction with the social partners and must be presented to national parliaments, which, along with the Community bodies, would monitor their implementation.

- (PT) Bien que je sois d’accord, en substance, sur pratiquement tous les points et que je souscrive aux préoccupations du rapporteur, j’ai voté contre son rapport car j’estime, dans la ligne de la commission juridique, que le texte proposé enfreint le principe de subsidiarité et parce que je considère, surtout au moment où la Convention débat de cette question dans le cadre de l’avenir de l’Union européenne et qu’elle tente de clarifier la répartition sans équivoque des compétences entre l’Union et les États membres, qu’il revient à toutes les instances communautaires - et tout particulièrement à notre Parlement - d’afficher un respect scrupuleux de ce principe de base.
– (PT) Despite the fact that, on almost all points, I agree substantially with and subscribe to the rapporteur’s concerns, I have decided to vote against the report because I, like the Committee on Legal Affairs and the Internal Market, feel that the proposed text breaches the principle of subsidiarity and that, particularly at a time when the Convention is discussing this matter in the context of the future of the European Union and is attempting to clarify the definitive distribution of competences between the Union and the Member States, all Community bodies – and Parliament in particular – have a responsibility to demonstrate scrupulous respect for this fundamental principle.

(4) La décision n° 1600/2002/CE du Parlement européen et du Conseil du 22 juillet 2002 établissant le sixième programme d'action communautaire pour l'environnement(6) souligne la nécessité d'adopter une approche fondée sur la connaissance pour élaborer, mettre en oeuvre et évaluer la politique environnementale et insiste en particulier sur la mise en place d'une surveillance des multiples fonctions des forêts, conformément aux recommandations d'instances telles que la conférence ministérielle sur la protection des forêts en Europe, le forum des Nations unies sur les forêts ou encore la convention sur la diversité biologique.
(4) Decision No 1600/2002/EC of the European Parliament and of the Council of 22 July 2002 laying down the sixth Community environment action programme(6) identifies the need to base the drawing-up, implementation and evaluation of environmental policies on a knowledge-based approach and, in particular, the need for monitoring the multiple roles of forests in line with recommendations adopted by the Ministerial Conference on the Protection of Forests in Europe and the United Nations Forum on Forests and the Convention on Biodiversity and other forums.
