Contrairement à l'article 61 du statut, qui traite des pourvois contre des décisions du Tribunal de première instance formés devant la Cour de justice sur des questions de droit, selon lequel la Cour peut soit statuer définitivement sur le litige lorsque celui-ci est en état d'être jugé, soit renvoyer l'affaire devant le Tribunal de première instance, le présent article établit le principe que, dans les pourvois en matière de brevets, le Tribunal de première instance statuera sur le litige.
