Compte tenu de l’arrêt récent (en date du 12 décembre 2006) du Tribunal de première instance des Communautés européennes (affaire T-228/02, Organisation des Modjahedines du peuple d’Iran/Conseil de l’Union européenne), reconnaissant la nécessité de faire preuve d’une plus grande transparence, de respecter le droit d’accès aux éléments à charge sur la base desquels une organisation politique est inscrite sur la «liste terroriste» de l’UE, de même que les droits à une protection juridictionnelle, le Conseil a-t-il l’intention de respecter la légalité démocratique européenne et de se conformer à l’arrêt du Tribunal de première instance des Communautés européennes en procédant à une révision de la procédure adoptée jusqu’ici pour établir la liste des organisations considérées comme terroristes?
Bearing in mind the recent judgment (12.12.2006) of the European Court of First Instance (Case T-228/02, the People's Mujahidin of Iran Organisation v. the Council), which recognises the need for greater transparency, respect of the right to know the evidence adduced against a political organisation on the basis of which it is included in the EU's 'terrorist list' and the right to judicial defence, does the Council of Ministers intend to ensure respect for Europe's democratic legal system and implement the judgment of the Court of First Instance of the European Communities by revising the procedure adopted hitherto for designating organisations as terrorist organisations?
