S’agissant des demandes tendant à ce que le Tribunal, d’une part, ordonne le reclassement du poste du requérant à un grade correspondant au niveau de ses responsabilités et, d’autre part, ordonne au SEAE de tirer toutes les conséquences, notamment pécuniaires, de ce reclassement, rétroactivement depuis l’entrée en fonctions du requérant, il y a lieu de rappeler que, dans le cadre d’un recours introduit au titre de l’article 91 du statut, le juge ne saurait, sans empiéter sur les prérogatives de l’autorité administrative, faire des déclarations ou des constatations de principe ni adresser des injonctions à une institution (voir ordonnance Caminiti/Commission, F‑71/09, EU:F:2011:53, point 23, et la jurisprudence citée).
With regard to the claims for the Tribunal, first, to order the applicant’s post to be regraded to a grade corresponding to the level of his responsibilities and, secondly, to order the EEAS to bear all the consequences, in particular the financial consequences, of that regrading, retrospectively from the time of his entry into the service, it should be noted that, in the context of an action brought under Article 91 of the Staff Regulations, the court may not, without encroaching upon the powers of the administration, make declarations or findings of principle, or issue directions to an institution (see order in Caminiti v Commission, F‑71/09, EU:F:2011:53, paragraph 23 and the case-law cited therein).

Ensuite, après avoir examiné et fait droit au premier moyen invoqué par M. Meierhofer, tiré de la violation de l’obligation de motivation (points 30 à 55 de l’arrêt attaqué), le Tribunal de la fonction publique a annulé la décision du 19 juin 2007 et condamné la Commission aux dépens tout en rejetant les autres chefs de conclusions de M. Meierhofer au motif que le juge est manifestement incompétent pour adresser des injonctions aux institutions.
Subsequently, after considering and allowing the first plea put forward by Mr Meierhofer, alleging breach of the obligation to state reasons (paragraphs 30 to 55 of the judgment under appeal, the Civil Service Tribunal annulled the decision of 19 June 2007 and ordered the Commission to pay the costs, while rejecting the other heads of claim on the ground that the Community judicature manifestly has no jurisdiction to issue directions to the Community institutions.

According to settled case‑law, the Community judicature is not entitled, when exercising judicial review of legality, to issue directions to the institutions or to assume the role assigned to them (see, inter alia, Joined Cases T‑374/94, T‑375/94, T‑384/94 and T‑388/94 European Night Services and Others v Commission [1998] ECR II‑3141, paragraph 53, and Case T‑127/98 UPS Europe v Commission [1999] ECR II‑2633, paragraph 50).
