However, the maintenance of criminal sanctions instead of administrative sanctions for breaches of this Directive should not reduce or otherwise affect the ability of competent authorities to cooperate, access and exchange information in a timely way with competent authorities in other Member States for the purposes of this Directive, including after any referral of the relevant breaches to the competent judicial authorities for criminal prosecution.

B. considérant que le procureur public fait référence à des poursuites concernant une infraction présumée à la loi polonaise du 20 mai 1971 établissant un code des infractions et à la loi sur la circulation routière du 20 juin 1997, en lien avec un accident de la circulation survenu le 2 septembre 2011 en Pologne, dans lequel Jarosław Leszek Wałęsa a été impliqué et grièvement blessé;
B. whereas the request by the Public Prosecutor relates to proceedings concerning an alleged offence under the Polish Act of 20 May 1971 establishing a Code of Offences and the Road Traffic Act of 20 June 1997 in relation to a traffic accident on 2 September 2011 in Poland in which Jarosław Leszek Wałęsa was involved and in which he was severely injured;
