Stresses that the Commission shall be informed of all future intergovernmental energy agreements with non-EU parties in line with Decision No 994/2012/EU establishing an information exchange mechanism with regard to intergovernmental agreements between Member States and third countries in the field of energy ahead of signing in order to make sure that they comply with EU legislation, in particular with the Third Energy Package, and do not threaten EU security of energy supply; highlights that such discussion and consultation must serve as a tool for strengthening the negotiating power of EU Member States and companies, while fully respecting commercially sensitive information; considers that such discussion and consultation should not in any way prejudice the substance and content of agreements, but ensure that they are compliant with all relevant Union law and in the best interests of the companies and Member States concerned; calls on the Commission to revise Decision No 994/2012/EU so as to strengthen the information mechanism accordingly and boost the Commission’s role;

Question No. 380 Ms. Elizabeth May: With regard to the recommendation made by Jeremy Wallace, Deputy Director of Climate Change at the Department of Foreign Affairs and International Trade (DFAIT), that funding provisionally approved on April 29, 2011, by the DFAIT Planning, Advocacy, and Innovation Office, for the purpose of supporting an art exhibition by Canadian artist Franke James in Eastern Europe, be cancelled based on a determination that, “concerns that the funding proposed would not be consistent with our interests () and would in fact run counter to Canada’s interests more broadly”: (a) what specific criteria and evidence did the government use to determine that Ms. James’ art exhibition would constitute a threat to the interests of Canada; (b) for each correspondence, including e-mails, that relate to this determination, including those between Ministers’ exempt staff and departmental staff at DFAIT, (i) what are its details, (ii) what are the names of the sender and recipients, (iii) on what date was it sent; (c) on what evidence did DFAIT rely in order to justify the redactions, under Sections 20(1)(c), 21(1)(b), and 15(1) of the Access to Information Act, to the correspondence released to Ms. James under her Access to Information Act request on this matter on August 16, 2011; and (d) with regard to the Right to Freedom of Speech enshrined in the Canadian Charter of Rights and Freedoms, on what legal grounds did DFAIT base its decision to withdraw support and revoke Ms. James’ allotted funding?

Reminds the Council and the VP/HR that they are obliged to keep Parliament informed about the state of external relations and in particular relations with third countries and international organisations with which international agreements are being negotiated or have been concluded in the EU's interest; reminds the Council that, where they do not relate exclusively to the CFSP, agreements on the exchange of confidential information with third countries and international organisations must be negotiated and concluded in such a way as to enable Parliament to be informed and involved in accordance with Article 218(6) TFEU; bearing that point in mind, reserves the right to determine whether the Agreement between the Member States of the European Union, meeting within the Council, regarding the protection of classified information exchanged in the interests of the European Union does not interfere with the exercise of the prerogatives conferred on it by the Treaty;
