Calls on the Commission, in applying Article 23 of the CPR, to devise a transparent, effective and democratic decision-making process to be applied in a consistent manner, in line with Article 23(15) of the CPR, which would include introducing an early warning system to inform the country concerned about the possibility of launching the reprogramming procedure immediately after the publication of the CSRs, and to allow Parliament, on the basis of a formalised process, to be informed at all stages of the adoption of reprogramming requests or of any proposals and decisions on suspension of commitments or payments;

C. considérant que d'après les informations divulguées, certains États membres de l'Union auraient coopéré au programme Prism conduit par les États‑Unis ou auraient mis en place des programmes de collecte de renseignements similaires, tels que le projet "Tempora" mené par le GCHQ (agence britannique d'espionnage électronique); considérant que des informations parues dans la presse ont révélé que le GCHQ s'était connecté à des câbles sous­‑marins à fibres optiques pour avoir accès aux conversations téléphoniques et aux communications sur internet dans le cadre d'un programme portant le nom de code Tempora, en se fondant sur le paragraphe 4 de la section 8 de la loi portant réglementation des pouvoirs d'enquête (RIPA), qui permet au ministre britannique des affaires étrangères de délivrer une autorisation d'interception à large échelle de certaines catégories d'informations liées au terrorisme ou à la criminalité organisée; considérant que des éléments de preuve indiquent que les États-Unis ont été impliqués dans des activités d'espionnage ciblant le personnel diplomatique des représentations permanentes des États membres, ainsi que dans les bureaux des institutions de l'Union européenne; considérant, à cet égard, que le bureau d'un député au Parlement européen a été mis sous écoute par les services de sécurité britanniques;
C. whereas the abovementioned leaks reveal that EU Member States were allegedly cooperating in the US-led PRISM Programme or have developed similar intelligence‑gathering programmes, such as the ‘Tempora’ Project led by the UK’s Government Communications Headquarters (GCHQ); whereas press reports have revealed that GCHQ has tapped into undersea fibre-optic cables to obtain access to telephone conversations and internet traffic under a programme codenamed TEMPORA, basing itself on paragraph 4 of section 8 of the Regulation of Investigatory Powers Act (RIPA), which allows the UK Foreign Secretary to issue a certificate for broad interception of categories of material relating to terrorism or organised crime; whereas there is evidence which indicates that the US has been involved in spying on diplomatic personnel of the Permanent Representations of the Member States, as well as the offices of the EU institutions; recalls, in this regard, the bugging of an MEP’s office by the British security services;

In June 2009 the Commission presented a package proposal to establish an Agency responsible for the operational management of large-scale information technology systems in the area of freedom, security and justice, consisting of a proposal for a regulation establishing the Agency and a proposal for a Council Decision conferring upon the Agency established by this regulation tasks regarding the operational management of the Second Schengen Information System (SIS II), the Visa Information System (VIS) and the European Dactylscopy (EURODAC) in application of Title VI of the EU Treaty, under the former third pillar.

Dans un souci de clarté, il convient donc d’abroger le règlement (CE) no 1071/2005 de la Commission du 1er juillet 2005 portant modalités d’application du règlement (CE) no 2826/2000 du Conseil relatif à des actions d’information et de promotion en faveur des produits agricoles sur le marché intérieur (2) et le règlement (CE) no 1346/2005 de la Commission du 16 août 2005 portant modalités d’application du règlement (CE) no 2702/1999 du Conseil relatif à des actions d’information et de promotion en faveur des produits agricoles dans les pays tiers (3) et de les remplacer par un règlement unique, tout en conservant, dans des chapitres distincts, les spécificités des actions en fonction de leur lieu de réalisation.
In the interests of clarity, Commission Regulation (EC) No 1071/2005 of 1 July 2005 laying down detailed rules for applying Council Regulation (EC) No 2826/2000 on information and promotion actions for agricultural products on the internal market (2) and Commission Regulation (EC) No 1346/2005 of 16 August 2005 laying down detailed rules for the application of Council Regulation (EC) No 2702/1999 on measures to provide information on, and to promote, agricultural products in third countries (3) should therefore be repealed and replaced by a single regulation, whilst maintaining, in separate chapters, the specific features of measures according to the market in which they are implemented.

Non-beneficial nutrition claims are not covered by the scope of this Regulation; Member States intending to introduce national schemes relating to non-beneficial nutrition claims should notify such schemes to the Commission and to other Member States in accordance with Directive 98/34/EC of the European Parliament and of the Council of 22 June 1998 laying down a procedure for the provision of information in the field of technical standards and regulations and of rules on Information Society services (4).
