Member States shall ensure that the storing of information, or the gaining of access to information already stored, in the terminal equipment of a subscriber or user is only allowed on condition that the subscriber or user concerned has given his or her consent, having been provided with clear and comprehensive information, in accordance with Directive 95/46/EC, inter alia, about the purposes of the processing.

3. Les États membres garantissent que le stockage d'informations ou l'accès à des informations déjà stockées dans l'équipement terminal d'un abonné ou d'un utilisateur ne soit permis qu'à condition que l'abonné ou l'utilisateur soit muni, dans le respect de la directive 95/46/CE, d'une information claire et complète, entre autres sur les finalités du traitement, et qu'il ait le droit de refuser un tel traitement par le responsable du traitement des données.
3. Member States shall ensure that the storing of information, or access to information already stored, in the terminal equipment of a subscriber or user is only allowed on condition that the subscriber or user concerned is provided with clear and comprehensive information, in accordance with Directive 95/46/EC, inter alia about the purposes of the processing, and is offered the right to refuse such processing by the data controller.

3. Les États membres garantissent que le stockage d'informations, ou l'obtention de l'accès à des informations déjà stockées, dans l'équipement terminal d'un abonné ou d'un utilisateur, soit directement, soit indirectement au moyen de tout type de support de stockage, est interdit, sauf si l'abonné ou l'utilisateur concerné a donné son consentement préalable, sachant que la fixation de paramètres du navigateur constitue un consentement préalable, et qu'il reçoit , dans le respect de la directive 95/46/CE, une information claire et complète, entre autres sur les finalités du traitement, et que le droit de refuser un tel traitement lui est donné par le responsable du traitement des données.
3. Member States shall ensure that the storing of information, or gaining access to information already stored, in the terminal equipment of a subscriber or user, either directly or indirectly by means of any kind of storage medium, is prohibited unless the subscriber or user concerned has given his/her prior consent, taking into account that browser settings constitute prior consent, and is provided with clear and comprehensive information in accordance with Directive 95/46/EC, inter alia about the purposes of the processing and is offered the right to refuse such processing by the data controller.
