3. The agreed arrangements to be established by common accord with a view to preserving the confidentiality of the information, in the case of confidential information communicated by the Commission pursuant to point 3.2 of Annex II to the Framework Agreement, or in the case of classified information forwarded by the Council pursuant to Article 5(4) of the Interinstitutional Agreement, shall be deposited, together with the confidential information, at the secretariat of the parliamentary body/office-holder or at the CIU, as the case may be.

Les informations confidentielles communiquées dans le cadre du présent accord peuvent être diffusées par la partie destinataire aux personnes qu’elle emploie, y compris à ses sous-traitants et à ses autres services concernés, pour autant que ceux-ci soient dûment autorisés aux fins spécifiques de la recherche conjointe en cours, en fonction du besoin d’en connaître et à condition que toute information confidentielle ainsi diffusée soit protégée conformément à la présente annexe et dans la mesure prévue par les dispositions législatives et réglementaires de chaque partie et soit facilement identifiable en tant que telle conformément aux dispositions mentionnées ci-dessus.
Undisclosed information communicated under this Agreement may be disseminated by the receiving Party to persons employed by the receiving Party, including its contractors and other concerned departments of the Party authorised for the specific purposes of the joint research underway, on a-need-to-know basis and provided that any undisclosed information so disseminated shall be protected in accordance with this Annex and to the extent provided by each Party’s laws and regulations, and shall be readily recognisable as such, as set out above.
