6. If the sum of co-financing that is necessary for funding projects, other than integrated projects, that are submitted by a Member State, and that are on the list compiled by the Commission at the end of the selection procedure is less than the indicative allocation for that Member State, the Commission shall, subject to the conditions laid down in paragraphs 1 and 2 being met, use the balance of that indicative national allocation to co-finance those projects submitted by other Member States, excluding projects in OCTs, that make the greatest contribution to the achievement of the general objectives set out in Article 3.

Lorsqu'une autorité compétente d'un État membre ou l'AEMF estime qu'un indice de référence administré dans un autre État membre dont la valeur notionnelle moyenne est inférieure au montant fixé au paragraphe 1, premier alinéa, point a), devrait néanmoins être jugé d'importance critique, car la cessation de cet indice aurait des incidences négatives notables sur l'intégrité des marchés, la stabilité financière, les consommateurs, l'économie réelle ou le financement des ménages et des sociétés au sein de sa juridiction, elle demande à l'autorité compétente nationale de l'administrateur de l'indice de référence en question de classer l'indice de référence parmi les indices d'importance critique.
Where a competent authority of a Member State or ESMA considers that a benchmark administered in another Member State with an average notional value totalling less than the amount set in point (a) of the first subparagraph of paragraph 1 should nevertheless be deemed to be critical, as the cessation of that benchmark would have a significant adverse impact on the integrity of markets, financial stability, consumers, the real economy, or the financing of households and corporations within its jurisdiction, it shall issue a request to the national competent authority of the relevant benchmark administrator to categorise the benchmark as critical.

2 bis. 2. Where it appears from the controls provided for in Article 4 that a natural person is entering or leaving the Community with sums of cash lower than the threshold fixed in Article 3 and where there are indications of illegal activities associated with the movement of cash, as referred to in Directive 91/308/EEC, that information, the full name, date and place of birth and nationality of that person and details of the means of transport used may also be recorded and processed by the competent authorities of the Member State referred to in Article 3(1) and be made available to the authorities referred to in Article 6(1) of Directive 91/308/EEC of that Member State.

Out of the “quota” of the newly created planting rights provided for in Article 6(1) of Regulation (EC) No 1493/1999, new planting rights could be granted by the Member States no later than 31 July 2003 for the production of quality wines psr or table wines described by means of a geographical indications where it was recognised that, owing to their quality, the production of the wines in question was far below demand (see Article 3(2) to (5) and Article 6 of the Regulation (EC) No 1493/1999).

This activity shall not include: (a) flights performed exclusively for the transport, on official mission, of a reigning Monarch and his immediate family, Heads of State, Heads of Government and Government Ministers, of a country other than a Member State, where this is substantiated by an appropriate status indicator in the flight plan (b) military flights performed by military aircraft and customs and police flights (c) flights related to search and rescue, fire-fighting flights, humanitarian flights and emergency medical service flights authorised by the appropriate competent authority (d) any flights performed exclusively under visual flight rules as defined in Annex 2 to the Chicago Convention (e) flights terminating at the aerodrome from which the aircraft has taken off and during which no intermediate landing has been made (f) training flights performed exclusively for the purpose of obtaining a licence, or a rating in the case of cockpit flight crew where this is substantiated by an appropriate remark in the flight plan provided that the flight does not serve for the transport of passengers and/or cargo or for the positioning or ferrying of the aircraft (g) flights performed exclusively for the purpose of scientific research or for the purpose of checking, testing or certifying aircraft or equipment whether airborne or ground-based (h) flights performed by aircraft with a certified maximum take-off mass of less than 5 700 kg (i) flights performed in the framework of public service obligations imposed in accordance with Regulation (EEC) No 2408/92 on routes within outermost regions, as specified in Article 299(2) of the Treaty, or on routes where the capacity offered does not exceed 30 000 seats per year (j) flights which, but for this point, would fall within this activity, performed by a commercial air transport operator operating either:
