Dans le cas d'une demande présentée au titre de l'article 8, conduisant à l'autorisation d'une nouvelle indication pédiatrique, les paragraphes 1, 2 et 3 ne s'appliquent pas si le demandeur sollicite et obtient une prolongation d'un an de la période de protection de la mise sur le marché du médicament concerné, fondée sur le fait que ladite nouvelle indication pédiatrique apporte un avantage clinique important par rapport aux thérapies existantes, conformément à l'article 14, paragraphe 11, du règlement (CE) no 726/2004 ou à l'article 10, paragraphe 1, quatrième alinéa, de la directive 2001/83/CE.
5. In the case of an application under Article 8 which leads to the authorisation of a new paediatric indication, paragraphs 1, 2 and 3 shall not apply if the applicant applies for, and obtains, a one-year extension of the period of marketing protection for the medicinal product concerned, on the grounds that this new paediatric indication brings a significant clinical benefit in comparison with existing therapies, in accordance with Article 14(11) of Regulation (EC) No 726/2004 or the fourth subparagraph of Article 10(1) of Directive 2001/83/EC.

Applications may be submitted in accordance with the procedure laid down in Articles 5 to 15 of Regulation (EC) No 726/2004 for a marketing authorisation as referred to in Article 7(1) of this Regulation which includes one or more paediatric indications on the basis of studies conducted in compliance with an agreed paediatric investigation plan.

By the end of 2012 the Agency had agreed 600 paediatric investigation plans (see Table 1). Of these, 453 were for medicines that were not yet authorised in the EU (Article 7), while the remainder related to new indications for patent-protected products (Article 8) or paediatric-use marketing authorisations (Article 30).

Dans un premier temps, d’aucuns s’étaient inquiétés que les sociétés puissent se montrer réticentes à concevoir de nouvelles indications, de nouvelles formes pharmaceutiques et de nouveaux modes d’administration dans de petits marchés et pour des médicaments générant un faible chiffre d’affaires, afin d’échapper à la contrainte de l’obligation pédiatrique énoncée à l’article 8 du règlement.
A concern that was raised initially was that some companies would become reluctant to develop new indications, pharmaceutical forms and new routes of administration in small markets and for products with low sales, to avoid being bound by the paediatric obligation under Article 8 of the Regulation.
