A. considérant que les produits agricoles d'une origine géographique particulière qui possèdent des qualités déterminées ou qui sont fabriqués selon des méthodes traditionnelles peuvent prétendre à une protection unitaire des indications géographiques (IG) au niveau de l'Union;

Conformément à l'article 10, paragraphe 1, point c), du règlement (UE) no 1151/2012, la partie à l'origine de l'opposition a fait valoir que l'enregistrement de la dénomination «Liliputas» en tant qu'indication géographique protégée compromettrait l'existence d'une dénomination partiellement homonyme, de marques et de produits qui ont été mis sur le marché polonais en toute légalité bien plus de cinq ans avant la date de publication au Journal officiel de l'Union européenne (15 juin 2013) de la demande d'enregistrement de la dénomination «Liliputas» en tant qu'indication géographique protégée. Selon cette même partie, cet enregistrement compromettrait l'existence du produit dénommé «Liliput», un fromage polonais présentant des caractéristiques similaires au fromage «Liliputas» et dont le nom est phonétiquement semblable au nom «Liliputas».
In accordance with Article 10(1)(c) of Regulation (EU) No 1151/2012 the opponent alleged that the registration of ‘Liliputas’ as a Protected Geographical Indication would jeopardise the existence of a partly identical name, of trade marks and of products which have been legally on the Polish market for significantly more than five years preceding the date the application for registration of the name ‘Liliputas’ as Protected Geographical Indication was published in the Official Journal of the European Union (15 June 2013); according to the opponent, that registration would be a threat to the existence of the product named ‘Liliput’, which is a Polish cheese having characteristics similar to ‘Liliputas’ cheese and whose name is phonetically similar to the name ‘Liliputas’.

Les objectifs, les principes et les autres éléments essentiels relatifs à la définition, la désignation, la présentation, l'étiquetage et la protection des indications géographiques des produits vinicoles aromatisés sont déterminés par le législateur, tandis que la Commission devrait être en mesure d'adopter, au moyen d'actes délégués (selon l'article 290 du traité FUE), les processus de production, les méthodes d'analyse, les modifications nécessaires des définitions, exigences, restrictions, dénominations de vente et désignations, ainsi que les règles nécessaires pour les indications géographiques.
The objectives, principles and other essential elements relating to the definition, description, presentation, labelling and the protection of geographical indications of aromatised wine products will be determined by the legislator, while the Commission, by means of delegated acts (Article 290 TFEU), should be able to adopt rules on production processes and methods of analysis, the necessary amendments to the definitions, requirements, restrictions, sales denominations and descriptions, and the necessary rules on geographical indications.

Les appellations d’origine et les indications géographiques protégées sont les termes officiels désignés selon les règlements (CEE) no 2081/92, (CE) no 1107/96 et (CE) no 2400/96. Par «indication géographique pour les vins» on entend les termes officiels selon le règlement (CE) no 1493/99. «Dénominations géographiques pour des boissons spiritueuses» est le terme officiel selon le règlement (CEE) no 1576/89.
Protected designation of origin (PDO) and protected geographical indication (PGI) mean the official indications designated in accordance with Regulations (EEC) No 2081/92, (EC) No 1107/96 and (EC) No 2400/96.‘Geographical indications for wines’means indications within the meaning of Regulation (EC) No 1493/99.‘Geographical designations for spirituous beverages’ means the official designations according to Regulation (EEC) No 1576/89.
