L'UE et la Chine ont convenu aujourd'hui de publier formellement une liste de deux cents indications géographiques européennes et chinoises (100 pour chacune des parties), qui seront examinées à des fins de protection dans le cadre d'un accord bilatéral qui sera conclu en 2017.
The EU and China agreed today to formally publish a list of two hundred European and Chinese geographical indications -100 from each side- that will be considered for protection through a bilateral agreement to be concluded in 2017.

Grâce à l’AECG, plus de 140 indications géographiques européennes concernant des produits alimentaires et des boissons (du Tiroler Speck autrichien au Gouda néerlandais, en passant par le Roquefort français) bénéficieront d’un niveau de protection élevé sur le marché canadien, ce qui n’est pas le cas jusqu’ici.
Over 140 European Geographical Indications of food and drink products (from Tiroler Speck, from Austria, to Gouda and Roquefort cheeses from the Netherlands and France) will enjoy a high level of protection in the Canadian market, whereas without the agreement there is no such protection.

Conformément à l'article 10, paragraphe 1, point c), du règlement (UE) no 1151/2012, la partie à l'origine de l'opposition a fait valoir que l'enregistrement de la dénomination «Liliputas» en tant qu'indication géographique protégée compromettrait l'existence d'une dénomination partiellement homonyme, de marques et de produits qui ont été mis sur le marché polonais en toute légalité bien plus de cinq ans avant la date de publication au Journal officiel de l'Union européenne (15 juin 2013) de la demande d'enregistrement de la dénomination «Liliputas» en tant qu'indication géographique protégée. Selon cette même partie, cet enregistrement compromettrait l'existence du produit dénommé «Liliput», un fromage polonais présentant des caractéristiques similaires au fromage «Liliputas» et dont le nom est phonétiquement semblable au nom «Liliputas».
In accordance with Article 10(1)(c) of Regulation (EU) No 1151/2012 the opponent alleged that the registration of ‘Liliputas’ as a Protected Geographical Indication would jeopardise the existence of a partly identical name, of trade marks and of products which have been legally on the Polish market for significantly more than five years preceding the date the application for registration of the name ‘Liliputas’ as Protected Geographical Indication was published in the Official Journal of the European Union (15 June 2013); according to the opponent, that registration would be a threat to the existence of the product named ‘Liliput’, which is a Polish cheese having characteristics similar to ‘Liliputas’ cheese and whose name is phonetically similar to the name ‘Liliputas’.

Afin de compléter ou de modifier certains éléments non essentiels du présent règlement, il convient de déléguer à la Commission le pouvoir d’adopter des actes conformément à l’article 290 du traité sur le fonctionnement de l’Union européenne en ce qui concerne l’établissement des processus de production pour obtenir des produits vinicoles aromatisés; les critères de la délimitation des zones géographiques et les règles, restrictions et dérogations concernant la production dans lesdites zones; les conditions dans lesquelles le cahier des charges d’un produit peut inclure des exigences supplémentaires; la détermination des cas dans lesquels un producteur isolé peut solliciter la protection d’une indication géographique et les restrictions applicables au type de demandeur qui peut solliciter ladite protection; l’établissement des conditions à respecter dans le cadre d’une demande de protection d’une indication géographique, l’examen par la Commission, la procédure d’opposition et les procédures de modification et d’annulation des indications géographiques; l’établissement des conditions applicables aux demandes transfrontalières; la fixation de la date de présentation d’une candidature ou d’une demande, la date à partir de laquelle la protection s’applique et la date à laquelle la modification d’une protection s’applique; l’établissement des conditions dans lesquelles une modification est considérée comme mineure, et les conditions à respecter concernant la demande et l’approbation d’une modification lorsque cette modification n’implique aucun changement au document unique; les restrictions relatives à la dénomination protégée; la nature et le type d’informations à notifier dans le cadre de l’échange d’informations entre les États membres et la Commission, les méthodes de notification, les règles relatives au droit d’accès à l’information ou aux systèmes d’information mis à disposition et les modalités de publication des informations.
In order to supplement or amend certain non-essential elements of this Regulation, the power to adopt acts in accordance with Article 290 of the TFEU should be delegated to the Commission in respect of the establishment of production processes for obtaining aromatised wine products; criteria for the demarcation of geographical areas and rules, restrictions and derogations related to production in such areas; the conditions under which a product specification may include additional requirements; the determination of the cases in which a single producer may apply for the protection of a geographical indication and the restrictions governing the type of applicant that may apply for such protection; the establishment of the conditions to be complied with in respect of an application for the protection of a geographical indication, scrutiny by the Commission, the objection procedure and procedures for amendment and cancellation of geographical indications; the establishment of the conditions applicable to trans-border applications; the setting of the date for the submission of an application or a request, the date from which the protection applies and the date on which an amendment to a protection applies; the establishment of the conditions relating to amendments to product specifications, including the conditions when an amendment is considered minor and the conditions relating to the applications for, and approval of, amendments, which do not involve any change to the single document; the restrictions regarding the protected name; the nature and type of information to be notified in the exchange of information between Member States and the Commission, the methods of notification, the rules related to the access rights to information or information systems made available and the modalities of publication of the information.

Il convient que la Commission, par voie d’actes d’exécution et, eu égard à la nature particulière de ces actes, agissant sans appliquer le règlement (UE) no 182/2011, publie le document unique au Journal officiel de l’Union européenne, décide de rejeter une demande de protection d’une indication géographique sur la base de son irrecevabilité, et établisse et tienne un registre des indications géographiques protégées au titre du présent règlement, y compris l’inscription des dénominations géographiques existantes dans le registre ou leur effacement du registre.
The Commission should, by means of implementing acts and, given their special nature, acting without applying Regulation (EU) No 182/2011, publish the single document in the Official Journal of the European Union, decide whether to reject an application for protection of a geographical indication on grounds of inadmissibility and establish and maintain a register of geographical indications protected under this Regulation, including the listing of existing geographical designations in that register or their removal from the register.

L’accord entre l’Union européenne et la République de Moldavie relatif à la protection des indications géographiques des produits agricoles et des denrées alimentaires (1), signé à Bruxelles le 26 juin 2012, entrera en vigueur le 1er avril 2013.
The Agreement between the European Union and the Republic of Moldova on the protection of geographical indications of agricultural products and foodstuffs (1), signed in Brussels on 26 June 2012, will enter into force on 1 April 2013.
