41.1 (1) Despite section 41, a person may import into Canada an animal by-product or a thing containing an animal by-product, other than one described in section 45, 46, 47, 47.1, 49, 50, 51, 51.2 or 53, if an inspector has reasonable grounds to believe that the importation of the by-product or thing, by its nature, end use or the manner in which it has been processed, would not, or would not be likely to, result in the introduction into Canada of any reportable disease, any disease referred to in Schedule VII and any serious epizootic disease to which the species from which the by-product was derived is susceptible and that can be transmitted by the by-product, and the by-product or thing is not intended for use as animal food or as an ingredient in animal food.

52 (1) Despite anything in this Part, a person may import into Canada an animal by-product if the person produces a document that shows the details of the treatment of the by-product and an inspector has reasonable grounds to believe — based on the source of the document, the information contained in the document and any other relevant information available to the inspector and, if necessary, on an inspection of the by-product — that the importation of the by-product would not, or would not be likely to, result in the introduction into Canada, or the spread within Canada, of a vector, disease or toxic substance.

5 (1) This Permit only applies to wheat and wheat products and barley and barley products that are accounted for under subsection 32(1), (3) or (5) of the Customs Act, or placed in a bonded warehouse under subsection 19(2) of that Act, on or before the day, set out in a notice to be issued by the Minister of Foreign Affairs, on which, in the opinion of that Minister, the import access quantity for the period concerned, determined in accordance with subsection 6.2(1) of the Export and Import Permits Act in respect of those goods, will have been filled.

In order to improve the correlation between information concerning the movement of excise goods held by excise authorities and the information on excise goods that have been imported held by the authorities responsible for importation formalities, where excise goods are moved under a duty suspension arrangement from the place of importation, the consignor is to indicate the code of the customs office responsible for the completion of importation formalities relating to the excise goods to be moved under duty suspension.

In the light of information provided by the Chinese authorities, and the favourable results of the tests carried out on certain crustaceans caught in the Atlantic Ocean, on fish filets of certain fish species, and on gelatine, the Commission proposes to allow imports of these products from China to resume subject to monitoring and testing to ensure their safety.
