First, the General Court misinterpreted and misapplied Article 266 of the Treaty on the Functioning of the European Union (‘TFEU’ or ‘the Treaty’) in conjunction with Article 263 TFEU and the principle of effectiveness, the principle of conferral of powers, the principle of legal certainty, the principle of continuity of the legal order, the temporal application of law, the principle of legitimate expectations and the principles governing succession of legal rules, insofar as it annulled certain Commission decisions intended to carry out the Commission’s obligations under the judgments in Joined Cases T-218/03 to T-241/03, Boyle and others v Commission and Joined Cases C-373/06 P, C-379/06 P and C-382/06 P, Flaherty and others v Commission.

4. Lorsque l’autorité compétente de l’État membre d’accueil a des raisons claires et démontrables d’estimer qu’un intermédiaire de crédit opérant dans le cadre du régime de la libre prestation des services sur son territoire viole les obligations qui lui incombent en vertu des dispositions arrêtées en application de la présente directive ou qu’un intermédiaire de crédit possédant une succursale sur son territoire viole les obligations qui lui incombent en vertu des dispositions adoptées en application de la présente directive autres que celles prévues au paragraphe 2, elle en fait part à l’autorité compétente de l’État membre d’origine qui prend les mesures appropriées.
4. Where the competent authority of the host Member State has clear and demonstrable grounds for concluding that a credit intermediary acting within its territory under the freedom to provide services is in breach of the obligations arising from the measures adopted pursuant to this Directive or that a credit intermediary that has a branch within its territory is in breach of the obligations arising from the measures adopted pursuant to this Directive, other than those specified in paragraph 2, it shall refer those findings to the competent authority of the home Member State which shall take the appropriate action.
