Les instances compétentes de l'UE, y compris les groupes de travail concernés au sein du Conseil, devraient suivre la situation dans les domaines relevant de leur compétence, où le droit humanitaire international pourrait trouver à s'appliquer, en s'appuyant, au besoin, sur des avis concernant le droit humanitaire international et son applicabilité.

whereas the Foreign Affairs Council, when adopting the EU Guidelines on promoting compliance with international humanitarian law, emphasised the importance of dealing effectively with the legacy of serious violations by supporting appropriate accountability mechanisms, and underlined the key role which the International Criminal Court (ICC) can play in cases where the state or states in question are unable or unwilling to exercise their jurisdiction; whereas the EU Guidelines commit the ‘appropriate Council working groups’ to monitoring situations where IHL may apply and, in such cases, to recommending action to promote compliance with IHL (paragraph 15(a)).

Calls for enhanced institutional space for the international community to address common concerns relating to IHL implementation; welcomes the pledge of the EU and its Member States to the ICRC to strongly support the establishment of an effective mechanism on strengthening compliance with IHL, but calls on the VP/HR to report to Parliament on her objectives and strategy in terms of realising this pledge in the forthcoming intergovernmental process to find ways to enhance the implementation of IHL as agreed at the 32nd International Conference of the Red Cross and Red Crescent in December 2015, which could strengthen the governance system of IHL.

Any transfer to an international humanitarian organisation of personal data of a data subject who is physically or legally incapable of giving consent, with a view to accomplishing a task incumbent under the Geneva Conventions or to complying with international humanitarian law applicable in armed conflicts, could be considered to be necessary for an important reason of public interest or because it is in the vital interest of the data subject.

32. condamne les agressions permanentes contre les minorités religieuses, ainsi que le harcèlement et l'intimidation des défenseurs des droits de l'homme, des avocats et des journalistes; reconnaît les progrès accomplis dans la reconstruction du pays et dans la mise en œuvre de certaines des recommandations émises par la commission «Enseignements du passé et réconciliation», mais déplore que le gouvernement du Sri Lanka n'ait toujours pas diligenté d'enquêtes indépendantes et crédibles sur les violations des droits de l'homme et du droit humanitaire international commises dans le passé; approuve résolument la recommandation de la Haute-Commissaire aux droits de l'homme de créer un mécanisme d'enquête international indépendant qui pourrait contribuer à établir la vérité si les mécanismes d'enquête nationaux échouent à le faire;

Condemns the ongoing attacks on religious minorities, and the harassment and intimidation of human rights defenders, lawyers and journalists; acknowledges the progress made in reconstruction and the implementation of some of the recommendations made by the Lessons Learnt and Reconciliation Commission, but regrets the fact that the Government of Sri Lanka continues to fail to provide for independent, credible investigations into past violations of international human rights and humanitarian law; strongly supports the recommendation by the UN High Commissioner for Human Rights to establish an independent international inquiry mechanism which would contribute to establishing the truth if domestic inquiry mechanisms fail;
