21. Urges that the provision of humanitarian aid follows international humanitarian law, and that EU humanitarian aid not be subject to restrictions imposed by other partner donors; expresses its concerns over, and condemns, the continued use of rape and other forms of sexual and gender-based violence against women and girls as a war weapon in humanitarian emergencies; emphasises that this violence, along with its physical and psychological consequences, needs to be addressed; calls for a global commitment to ensure that women and girls are safe from the start of every emergency or crisis by addressing the risk of sexual and gender-based violence, by raising awareness, by assuring the prosecution of the perpetrators of such violence, and by ensuring that women and girls have access to the full range of sexual and reproductive health services, including safe abortions, in humanitarian crises, rather than perpetuating what amounts to inhumane treatment, as required by international humanitarian law and as foreseen in the Geneva Conventions and their Additional Protocols;

Au vu de la part importante d’aide humanitaire qu’elle fournit, l’UE est particulièrement bien placée pour i) garantir que sa réponse humanitaire est adéquate, efficace, basée sur des besoins évalués et qu’elle prend en compte des dimensions importantes, comme les besoins spécifiques de populations vulnérables, ainsi que pour ii) exercer son influence collective sur la préparation de l’ensemble du système humanitaire international.
Given the large share of humanitarian aid it provides, the EU acting together is particularly well placed to i) ensure that its humanitarian response is appropriate, effective, based on assessed needs, and takes into account important dimensions, such as the particular needs of vulnerable population groups; as well as to ii) exercise its collective influence on the preparedness of the international humanitarian system as a whole.

Appropriate legal advice, together with sufficient information about the particular context, should always be sought in determining whether a situation amounts to an armed conflict, and thus whether international humanitarian law is applicable.

Le droit humanitaire international comporte des règles qui visent à protéger des personnes ne participant pas ou ne participant plus directement aux hostilités, par exemple les civils, les prisonniers de guerre et autres détenus, les blessés et les malades, ainsi qu'à fixer des restrictions quant aux moyens et aux méthodes de la guerre, y compris en ce qui concerne la tactique et les armes utilisées, afin d'éviter les souffrances et destructions inutiles.
IHL comprises rules that seek to protect persons who are not, or are no longer, taking direct part in hostilities — such as civilians, prisoners of war and other detainees, and the injured and sick — as well as to restrict the means and methods of warfare — including tactics and weaponry — in order to avoid unnecessary suffering and destruction.

L'UE finance la diffusion du droit humanitaire international auprès d'un large éventail de parties prenantes, ainsi que des activités visant à renforcer les capacités des travailleurs humanitaires à promouvoir ledit droit; elle organise, en outre, de vastes campagnes d'information destinées à sensibiliser l'opinion publique au droit humanitaire international.
The EU funds IHL dissemination targeting a wide range of stakeholders, as well as activities aimed at increasing the capacities of humanitarian workers in advocating for IHL, and implements large-scale information campaigns to raise awareness of IHL across the general public.

Stresses that respect for international human rights and humanitarian law by all parties and in all circumstances remains an essential precondition for achieving a just and lasting peace in the Middle East; underlines the responsibility of Israel, as the occupying power, to comply with international humanitarian and human rights law and to exercise maximum restraint;
