La Commission a notamment établi que la viabilité à long terme de Hiltex ne pouvait être assurée (il y a des raisons de penser que cette société a été maintenue artificiellement en vie depuis un certain nombre d'années), que les distorsions de concurrence consécutives à l'aide n'étaient pas compensées, par des réductions de capacité, par exemple (Hiltex envisageait semble-t-il au contraire d'accroître ses capacités, alors que le marché en cause est caractérisé par une surcapacité de production structurelle) et, enfin, qu'il n'est pas démontré que l'aide était limitée au strict minimum nécessaire pour permettre la restructuration.
The Commission found in particular that the long-term viability of Hiltex could not be achieved (there are grounds to believe that the company was kept artificially alive for a number of years); that distortions to competition as a result of the aid were not counterbalanced, e.g. by capacity reductions (it rather appears that Hiltex intended to increase its capacities whilst the relevant market is characterised by a structural excess of production capacity); and that it has not been shown that the aid is limited to the strict minimum needed to enable the restructuring.
