Toutefois, dans la mesure où la mise dans le circuit commercial des HCFC à de telles fins constitue un acte en amont de l'utilisation de ces substances et n'a d'autre finalité que leur utilisation à ces mêmes fins, il convient d'en conclure que, l'utilisation des HCFC étant totalement interdite à compter du 1er juin 1995, leur commercialisation en tant que substances destinées à la lutte contre les incendies doit être considérée comme étant également interdite à partir de cette date.
The marketing of HCFCs for firefighting is not mentioned in Article 5 of the Regulation. However, in so far as the release of HCFCs into commercial channels for those purposes is a step preparatory to the use of such substances and has no aim other than their use for those same purposes, it must be concluded that, because the use of HCFCs has been totally prohibited since 1 June 1995, the marketing of them for firefighting must also be regarded as prohibited from that date.
