Dans ses conclusions, présentées aujourd'hui même, le premier Avocat général, Mme Christine Stix-Hackl, qui s’est vu confier l’affaire à la suite du départ de la Cour de l’Avocat général M. Jacobs, le 10 janvier 2006, partage le point de vue de ce dernier selon lequel l’IRAP, telle que décrite par le juge de renvoi, présente les caractéristiques essentielles de la TVA, par la généralité de son application, sa proportionnalité par rapport au prix, le fait qu’elle est perçue à chaque stade du processus de production et de distribution et le fait qu’elle est imposée sur la valeur ajoutée aux livraisons ou prestations à chaque stade et assortie d'un mécanisme de déduction de la taxe payée aux stades antérieurs – pour autant que, pour un échantillon représentatif d'opérateurs économiques, le rapport entre les montants payés au titre de l’IRAP et au titre de la TVA reste sensiblement constant.
In her Opinion today, First Advocate General Christine Stix-Hackl, who was assigned to the case following Advocate General Jacobs’s departure from the Court on 10 January 2006, concurs with Mr Jacobs that IRAP, as described by the referring court, possesses the essential characteristics of VAT, in terms of generality of application, proportionality to price, the fact that it is charged at each stage of the production and distribution process and the fact that it is imposed on the value added to a supply at each stage with a mechanism for deduction of that tax paid at previous stages – provided that the ratio between the amounts paid by a representative sample of business in IRAP and VAT is substantially constant.
