Conformément au règlement (CE, Euratom) no 1605/2002 du Conseil du 25 juin 2002 portant règlement financier applicable au budget général des Communautés européennes (1) et au règlement financier adopté par le conseil d'administration de l'Agence le 26 mars 2003, au règlement (CE, Euratom) no 2343/2002 de la Commission du 19 novembre 2002 portant règlement financier-cadre des organismes visés à l'article 185 du règlement (CE, Euratom) no 1605/2002 du Conseil portant règlement financier applicable au budget général des Communautés européennes (2), ainsi qu'aux autres réglementations auxquelles se réfère la présente décision, les contrats ou conventions conclus ainsi que les décisions prises avec des bénéficiaires établis en Suisse peuvent prévoir que des audits scientifiques, financiers, technologiques ou autres peuvent être effectués à tout moment auprès d'eux et de leurs sous-traitants par des agents de l'Agence et de la Commission ou par d'autres personnes mandatées par celles-ci.

In accordance with Council Regulation (EC, Euratom) No 1605/2002 of 25 June 2002 on the Financial Regulation applicable to the general budget of the European Communities (1) and the Financial Regulation adopted by the Management Board of the Agency on 26 March 2003, with Commission Regulation (EC, Euratom) No 2343/2002 of 19 November 2002 on the framework Financial Regulation for the bodies referred to in Article 185 of Council Regulation (EC, Euratom) No 1605/2002 on the Financial Regulation applicable to the general budget of the European Communities (2) and with the other instruments referred to in this Decision, contracts or agreements concluded and decisions taken with beneficiaries established in Switzerland may provide for scientific, financial, technological or other audits to be conducted at any time on the premises of the beneficiaries and of their subcontractors by Agency and Commission officials or by other persons mandated by the Agency and the Commission.

In contrast to Joint Technology Initiatives (JTI) constituted as Joint Undertakings of which the Community is a member and to which it makes financial contributions, a European Research Infrastructure Consortium (hereinafter referred to as ‘ERIC’) should not be conceived as a Community body within the meaning of Article 185 of Council Regulation (EC, Euratom) No 1605/2002 of 25 June 2002 on the Financial Regulation applicable to the general budget of the European Communities (the Financial Regulation), but as a legal entity of which the Community is not necessarily a member and to which it does not make financial contributions within the meaning of Article 108(2)(f), of the Financial Regulation.

(49) En ce qui concerne la réglementation financière applicable aux organismes créés par les Communautés, dotés de la personnalité juridique et qui reçoivent une subvention du budget général des Communautés européennes, il convient d'assurer un cadre adapté aux nécessités spécifiques de leur gestion.
(49) A suitable framework, tailored to the specific management needs, should be provided for the financial rules to apply to bodies set up by the Communities and having legal personality, which receive a subsidy from the general budget of the European Communities.

3. Si un ou plusieurs États ACP ou un ou plusieurs États membres de la Communauté rencontrent ou risquent de rencontrer de graves difficultés de balance des paiements, l'État ACP, l'État membre ou la Communauté peuvent, conformément aux conditions fixées dans le cadre de l'accord général sur les tarifs douaniers, l'accord général sur le commerce des services et aux articles VIII et XIV des statuts du Fonds monétaire international, adopter pour une durée limitée des mesures de restriction aux transactions courantes qui ne peuvent aller au-delà de ce qui est strictement nécessaire pour remédier à la situation de la balance des paiements.

Where one or more ACP State or one or more Member State of the Community is in serious balance of payments difficulties, or under threat thereof, the ACP State, the Member State or the Community may, in accordance with the conditions established under the GATT, GATS and Article VIII and XIV of the Articles of Agreement of the International Monetary Fund, adopt restrictions on current transactions which shall be of limited duration and may not go beyond what is necessary to remedy the balance of payments situation.
