7. On the basis of the statement of estimates, the Commission shall enter in the preliminary draft general budget of the Union the estimates it considers necessary for the establishment plan and the amount of the contribution to be charged to the general budget, which it shall place before the European Parliament and the Council in accordance with Article 314 TFEU, together with a description of and justification for any difference between the Agency's statement of estimates and the subsidy to be charged to the general budget.

E. whereas Article 36 of the Charter of Fundamental Rights of the European Union commits the Union to recognising and respecting ‘access to services of general economic interest as provided for in national laws and practices, in accordance with the Treaties, in order to promote the social and territorial cohesion of the Union’; whereas Article 14 TFEU establishes that ‘given the place occupied by services of general economic interest in the shared values of the Union as well as their role in promoting social and territorial cohesion, the Union and the Member States, each within their respective powers and with the scope of application of the Treaties, shall take care that such services operate on the basis of principles and condition, particularly economic and financial conditions, which enable them to fulfil their missions’; whereas Article 345 TFEU provides that the Treaties ‘shall in no way prejudice the rules in Member States governing the system of property ownership’; and whereas Protocol No. 26 on services of general interest elaborates on the shared values of the Union with respect to services of general economic interest;

In such cases, Member States measures have to be assessed in line with the Commission Communication on the application of the EU State aid rules to compensation granted for the provision of services of general economic interest (26), the Commission Decision of 20 December 2011 on the application of Article 106(2) of the Treaty on the Functioning of the European Union to State aid in the form of public service compensation granted to certain undertakings entrusted with the operation of services of general economic interest (27), the Commission Communication on a European Union framework for State aid in the form of public service compensation (2011) (28) and the Commission Regulation of 25 April 2012 on the application of Articles 107 and 108 of the Treaty on the Functioning of the European Union to de minimis aid granted to undertakings providing services of general economic interest (29).

Where public service obligations qualify as SGEI compliance should be ensured with Commission Decision of 20 November 2011 on the application of Article 106(2) of the Treaty on the Functioning of the European Union to State aid in the form of public service compensation granted to certain undertakings entrusted with the operation of services of general economic interest[8], Commission Regulation (EU) No 360/2012 of 25 April 2012 on the application of Articles 107 and 108 of the Treaty on the Functioning of the European Union to de minimis aid granted to undertakings providing services of general economic interest[9] and the European Union framework for State aid in the form of public service compensation[10].

J. whereas, notwithstanding this, with the Union's accession to the ECHR, the Union may over time have to find a common yardstick in cross-border cases relating to the freedoms to supply goods and services as a result of the ‘dialectical development’ looked forward to by Advocate General Mancini in the Bond van Adverteerders case, having regard also to the judgments in Elliniki Radiofonia Tileorasi and Society for the Protection of Unborn Children Ireland Ltd and Advocate General Jacobs' opinion in Christos Konstantinidis ; indeed, in the case Society for the Protection of Unborn Children Ireland Ltd , Advocate General Van Gerven put forward the proposition that ‘a national rule which in order to show that it is compatible with [Union] law has to rely on legal concepts, such as imperative requirements of public interest or public policy .falls ’within the scope' of [Union] law' on the ground that, although the Member States have some discretion in defining the public interest or public policy concepts, the scope of those concepts in the case of measures falling within the scope of Union law is nevertheless subject to Union control and they have to be ‘justified and delimited in a uniform manner for the whole [Union] under [Union] law and therefore taking into account the general principles in regard to fundamental rights and freedoms’;

to make full use of the provisions contained in UNGA resolution A/RES/65/276 on the EU's participation in the work of the United Nations, which makes the necessary arrangements for the EU to participate effectively in the work of the UNGA; to reconfirm its commitment that the UN is at the centre of the EU's foreign policy and to reiterate the view that its effective participation in the work of the UN is not only an EU strategic priority, but also consistent with achieving the UN's goals and, as such, in the interests of all UN members; to improve EU Member State coordination in the UNSC and to encourage Member States which are also members of the UNSC, and in accordance with Article 34 (2) TEU, to invite the VP/HR to represent the EU in the UNSC whenever a common position has been defined,
