En fonction de la recommandation de l’AEMF en la matière et des critères énoncés dans la présente directive, il convient également d’adopter un acte délégué afin d’étendre le passeport aux gestionnaires établis dans l’Union qui commercialisent des FIA de pays tiers dans l’Union ainsi qu’aux gestionnaires établis dans un pays tiers qui gèrent et/ou commercialisent des FIA dans l’Union, ainsi qu’un autre acte délégué pour mettre un terme à l’application des régimes de placement nationaux privés à cet égard.
Depending on the advice of ESMA in this regard and the criteria set out in this Directive, a delegated act should also be adopted in order to extend the passport to EU AIFMs marketing non-EU AIFs in the Union and to non-EU AIFMs managing and/or marketing AIFs in the Union, and another delegated act should be adopted to terminate the application of national private placement regimes in this regard.

3. À cette fin, à compter de l’entrée en vigueur de l’acte délégué visé à l’article 67, paragraphe 6, et jusqu’à ce que l’AEMF émette l’avis visé au paragraphe 1, point a), du présent article, les autorités compétentes fournissent chaque trimestre à l’AEMF des informations relatives aux gestionnaires qui gèrent et/ou commercialisent des FIA placés sous leur surveillance, soit dans le cadre du système de passeport établi dans la présente directive ou conformément à leurs systèmes nationaux.

To that end, as from the entry into force of the delegated act referred to in Article 67(6) and until the issuance of the ESMA opinion referred to in point (a) of paragraph 1 of this Article, the competent authorities shall, quarterly, provide ESMA with information on the AIFMs that are managing and/or marketing AIFs under their supervision, either under the application of the passport regime provided for in this Directive, or under their national regimes.

3. To that end, as from the entry into force of the national laws, regulations and administrative provisions necessary to comply with this Directive and until the issuance of the opinion of ESMA referred to in point (a) of paragraph 1, the competent authorities of the Member States shall, quarterly, provide ESMA with information on the AIFMs that are managing and/or marketing AIFs under their supervision, either under the application of the passport regime provided for in this Directive or under their national regimes, and with information needed for the assessment of the elements referred to in paragraph 2.

For the purposes of the review referred to in paragraph 1, Member States shall provide the Commission annually with information on the AIFMs that are managing and/or marketing AIFs under their supervision, either under the passport regime provided for in this Directive, or under their national regimes, with an indication of the date on which the passport regime has been transposed and, if relevant, applied, in their jurisdiction.
