In the first place, with regard to aid for olive oil, the Commission found that there were such significant deficiencies in the geographical information system for olive cultivation (‘olive cultivation GIS’), used in Greece for checking aid for olive-oil production, that that system had to be regarded as not having been completed in time for the 2003/2004 marketing year (the period from which the declarations of cultivation were to be checked by means of the olive cultivation GIS).

Le second rapport Deloitte confirme cette conclusion: «Sur la base de notre expérience et à la lumière de l’analyse précédente, nous tendons à considérer qu’aucun investisseur raisonnable n’aurait été disposé à acheter HSY et, en même temps, à assumer tout risque supplémentaire lié à des aides d’État (qui, à l’époque, n’était ni certain ni déterminé du point de vue quantitatif par la CE) pour la société qui a) durant plusieurs années appartenait et était gérée par une société appartenant à l’État (ETVA) et, en même temps, b) présentait des capitaux propres négatifs élevés, entre autres problèmes fonctionnels (tels que la productivité faible, les coûts d’exploitation élevés, le personnel excédentaire, etc.)» Cette conclusion est également confirmée par le fait que la Grèce, prévoyant que la garantie en cause serait nécessaire pour attirer des investisseurs privés, a promis dans les documents de l’appel d’offres que le plus-offrant recevrait une garantie relative (162).
The second Deloitte report confirms this conclusion: ‘Based on our experience and the above analysis, we tend to believe that no rational investor would have been prepared to acquire HS and in parallel assume any additional risk related to State aid (which at that time was neither certain nor quantified by the EC), for the company that a) was under the ownership and management of a State-owned company (ETVA Bank) for a number of years, and at the same time b) had a significant negative shareholders’ equity position, amongst other operational problems (i.e. low productivity, high operational costs, excess staff, etc.)’. This conclusion is also confirmed by the fact that Greece, anticipating that such a guarantee would be necessary to attract private investors, promised in the tender documents that the highest bidder would receive such a guarantee (162).
