The regime has been maintained in Bill S-4 with the following amendments: The limits of liability have been increased; the right to limit liability has been extended to servants and agents of the owners of docks, canals and ports in order to achieve uniformity with a similar provision respecting the agents and servants of shipowners; and, finally, we have removed any reference to nationality of the largest ship for the calculation of the limit of liability in order to achieve a more flexible application of this provision, which currently uses for this calculation the " largest British ship in the area of the accident" .

(2) Les navires britanniques, à l’exclusion des navires canadiens, construits dans un pays bénéficiant du Tarif de préférence britannique ou au Royaume-Uni de Grande-Bretagne et d’Irlande du Nord, dans les îles anglo-normandes, à l’île de Man, en République d’Irlande ou à Hong Kong et loués en vertu d’un contrat écrit conclu avant le 6 janvier 1983 en vue de leur affectation au cabotage dans les conditions prévues à la partie X de la Loi sur la marine marchande du Canada, sont réputés libérés des droits et taxes de la législation douanière fédérale pendant la durée du bail du premier locataire canadien ou toute période de reconduction du bail, à l’exclusion des reconductions conclues au plus tôt le 6 janvier 1983.
(2) British ships, other than Canadian ships, the product of a country entitled to the benefits of the British Preferential Tariff or the product of the United Kingdom of Great Britain and Northern Ireland, the Channel Islands, the Isle of Man, the Republic of Ireland or Hong Kong, under lease pursuant to a written contract entered into prior to January 6, 1983 for the purpose of engaging in the coasting trade of Canada pursuant to Part X of the Canada Shipping Act, shall be deemed to be duty and tax paid ships under federal customs laws throughout the term of the lease to the first Canadian lessee or any renewal thereof, excluding renewals entered into on or after January 6, 1983.
