The preamble of Regulation (EC) No 1013/97 indicates ‘Whereas, in spite of the efforts made by the Greek Government to privatise all its public yards by March 1993, the Hellenic shipyards was only sold in September 1995 to a cooperative of its workers, the State having kept a majority holding of 51 % for defence interests; Whereas the financial viability and the restructuring of the Hellenic shipyard necessitates the provision of aid which allows the company to write-off the debt accumulated before its delayed privatisation’.

In particular, Greece recalls that ‘The Commission mentioned in its Decision of 31 October 1995 that it will continue to examine, within the procedure it had opened, all the actions of the Greek Government regarding the application of the agreement to transfer 49 % of the shares to the employees’ union, as well as its content, before taking a final decision on the authorisation of the debt write-off.

Following discussions with the Commission, the Greek Government has introduced a number of important new conditions to be met by the company such as : - the introduction of a sound economic restructuring and re-organisation programme which includes a 25 % reduction in weaving production capacity and no increase in capacity in any area of production before 1991 ; - a significantly expanded investment programme to be financed entirely from the company's own resources ; - the payment of a guaranteed dividend on equity capital to the shareholders, the national Bank of Greece and the Business Reconstruction Organisation ; - no further aid may be paid to the company without prior Commission approval. The Commission considers that the changes introduced into the aid bring it into conformity with the Community guidelines on aid to the textile and clothing sector.

The Commission filed its submission before the end of the transitional period and claimed that even though it was true to say that there was no common organization of the banana market and that there was a national organization for the product concerned which was the line of argument taken by the Greek government, a total import ban could not be considered strictly necessary to safeguard the national banana market organization.
