As a German Member, I am particularly pleased that the German Federal Government has finally ceased its blocking of a permanent regulation.

With a first letter of its Federal Ministry of Economics and Technology, received on 20 January 2011, the German Federal Government requested the Commission, pursuant to Article 114(4) TFEU, the permission to retain the existing provisions provided in German law for the five elements: lead, arsenic, mercury, barium and antimony, as well as for nitrosamines and nitrosatable substances released from toy material, beyond the date of entry into force of Annex II, Part III, to the Directive.

On 20 January 2011, the German Federal Government requested the Commission, pursuant to Article 114(4) TFEU, the permission to retain the existing provisions provided in German law for the five elements: lead, arsenic, mercury, barium and antimony, as well as for nitrosamines and nitrosatable substances released from toy material, beyond the date of entry into force of Annex II, Part III, to Directive 2009/48/EC of the European Parliament and of the Council of 18 June 2009 on the safety of toys (1) (hereinafter ‘the Directive’).

A complete justification of the request has been sent by the German Federal Government with letter from the Office of its Permanent Representative, dated 2 March 2011.

The Commission also published a notice regarding the notification in the Official Journal of the European Union (3) in order to inform other interested parties of the national provisions the German Federal Government intends to maintain as well as the grounds invoked to that effect.

On the assumption that you mean the position of the German Federal Government, Mrs Harms, I suggest that there are a number of things of which you need to take note, the first of which is that your assertion that the German Federal Government is opposed to a legislative proposal and to Europe-wide legislation laying down CO2 emissions of 120 gram per kilometre is very definitely wrong.

J’espère également que le gouvernement fédéral allemand ne suivra pas la suggestion de Mme Sommer et n’interjettera pas appel. Tout gouvernement - pas seulement le gouvernement allemand - interjetant appel contre quelque chose qui a été accepté par le Conseil se rendrait ridicule et perdrait de sa crédibilité.
I also hope that the German Federal Government will not act on Mrs Sommer’s suggestion and lodge an appeal; any government – not just the German one – that appealed against something after having agreed to it in the Council would make itself look ridiculous and lose credibility, and so I hope that tomorrow will see us achieving a milestone in our quest for more protection for consumers and for their health.

Je dois dire très clairement que je trouve honteux que le gouvernement fédéral allemand rouge-vert ait suivi l'ancien gouvernement fédéral et introduit une plainte auprès de la CJCE.
I make no bones about the fact that I think it is disgraceful how the Red-Green Federal Government followed the former Federal Government’s example in lodging a complaint against this at the European court of Justice.
