Le gouvernement espagnol ajoute, entre autres, que le critère des circonstances exceptionnelles, imprévisibles et extérieures ne saurait se confondre avec la force majeure, que l'incidence totale du caractère exceptionnel et imprévisible de la récession en Espagne sur les recettes d'Iberia s'élève à 59 milliards de pesetas espagnoles, qu'Iberia sera bientôt aussi compétitive que Viva Air et que cette dernière a sa place sur le marché charter, qu'enfin la Commission ne peut légalement imposer des cessions d'actifs à Iberia et qu'il n'existe aucune alternative à l'injection de capital prévue, car Iberia ne dispose plus de non essential assets.
