Fifth plea in law, alleging a manifest error of assessment, in that (i) the applicant was never subject to any judicial investigation for misappropriation of State funds; (ii) the behaviour of Mr Ezz constitutes normal activities in the course of trade and therefore cannot be regarded as misappropriation of State funds; and (iii) at the time of the adoption of Decision 2014/153, the Council did not take account of the fact that, three years after the adoption of the first measures, Mr Ezz’s legal position remains, at the very least, uncertain.

According to the appellant, the General Court should have recognised that the contested decision was erroneous in the part pertaining to those nine checks, and should therefore have upheld the Italian Government’s submissions that the Commission had breached Article 39(2) and (3) of Regulation No 1260/1999, given that it had adopted a decision to make a flat-rate correction of 10 % without there being any proof of irregularities from the sample of first-level checks, and (even if the other irregularities are assumed to have occurred) in a manner which was certainly excessive in the light of the principle of proportionality, as laid down in Article 39 of Regulation No 1260/1999.

As shown in the graph above, the fact that retail electricity prices have, on average across all users, remained relatively constant in real terms over the period, despite very obvious price increases in the cost of primary fuels, clearly demonstrates the effect of increasing efficiency in electricity supply. The electricity price in particular for households would in fact have decreased if the effects of taxation were excluded.

All the factors relied on by the applicant – referred to at paragraphs 17 to 19, 21 and 22 above – in order to demonstrate the distinctiveness of the marks claimed relate to the possibility of the torches in question having acquired distinctiveness following the use made of them, and cannot therefore be regarded as relevant for the purposes of assessing their inherent distinctiveness under Article 7(1)(b) of Regulation No 40/94.

However, where a retirement or invalidity pension becomes payable to an official or other servant to whom the first indent of paragraph 2 has been applied before he leaves the service and to whom application of the tables in force on 30 June 1979 would have given a net pension higher than the net amount obtained from the tables that entered into force on 1 July 1979, the amount to be paid shall be calculated in the manner prescribed by paragraph 1 (b).
