The European Parliament has come to the conclusion that, ‘according to information given by Murat Kurnaz's lawyer and information provided by the German authorities, there was a prospect of the release of Murat Kurnaz from Guantánamo in 2002 but this was not accepted by the German authorities’ and that ‘Murat Kurnaz's lawyer was told by the German Government that it was impossible to open negotiations with the US Government on his release because Murat Kurnaz was a Turkish citizen’ even though ‘all investigations had established, by as early as at the end of October 2002, that Murat Kurnaz posed no terrorist threat’.

Where an auxiliary staff member or assistant to Members of the European Parliament , employed in the territory of a Member State other than Germany, has opted for German legislation to be applied, the provisions of that legislation shall be applied as though the auxiliary staff member or assistant were employed in the place where the German Government has its seat or as though the auxiliary staff member or assistant were employed in the place in which he had last been permanently resident in Germany.

(176) Selon le gouvernement allemand, le Land de Rhénanie-du-Nord-Westphalie n'était pas contraint d'envisager la privatisation de la WestLB pour renforcer sa dotation en fonds propres. Le Land était entièrement libre de transférer la Wfa à la WestLB dans le but de mettre en oeuvre une synergie; il n'était pas non plus tenu par le droit communautaire d'envisager un transfert de la Wfa à un établissement de crédit privé.
(176) The German Government argues that the Land of North Rhine-Westphalia was not obliged to consider privatising WestLB in order to increase the latter's equity, that the Land was in principle free to transfer Wfa to WestLB in order to achieve synergies and that the Land was not obliged under Community law to consider the transfer of Wfa to a private credit institution. This argument can be accepted.
