IN-CONTEXT TRANSLATIONS

La Commission a décidé de saisir la Cour de justice de l’UE (la Cour) d’un recours contre le Portugal pour non-respect d’un précédent arrêt de la Cour concernant les règles de l’UE visant à garantir l’équilibre des comptes des gestionnaires de l’infrastructure ferroviaire.Dans son arrêt du 25 octobre 2012 dans l'affaire C-557/10, la Cour a déclaré que le Portugal, en n’adoptant pas les mesures nationales nécessaires pour garantir que les comptes du gestionnaire de l’infrastructure sont en équilibre, a manqué aux obligations qui lui incombent en vertu du droit de l’UE (premier paquet ferroviaire).
The Commission has decided to refer Portugal to the Court of Justice of the EU (the Court) for failing to comply with a previous judgement of the Court concerning EU rules on balancing the accounts of rail infrastructure managers. In Judgement C-557/10 of 25 October 2012, the Court ruled that Portugal was in breach of EU law (first railway package) for not adopting the national measures necessary to ensure that the accounts of the rail infrastructure manager are balanced.

Next, the Commission claims that Slovenia has not made provision for measures encouraging managers to reduce the costs for the provision of infrastructure and the level of access charges, nor has it implemented the performance scheme for railway undertakings and the infrastructure manager which corresponds to the requirements of EU law.

Concernant, en deuxième lieu, le grief de la Commission tiré de l’absence de mesures encourageant le gestionnaire de l’infrastructure à réduire les coûts de fourniture de l’infrastructure et le niveau des redevances d’accès, la Cour examine le financement étatique du gestionnaire de l’infrastructure invoqué par la République tchèque.
Secondly, concerning the Commission’s complaint that there are no measures encouraging managers to reduce the costs for the provision of infrastructure and the level of access charges, the Court examined the State funding of the infrastructure manager, relied on by the Czech Republic.

State support granted to an infrastructure manager, public or private but separate from the State, for the management, maintenance, realisation or provision of inland transport infrastructure is presumed to be compatible with the common market if the infrastructure managed by that manager is open to all potential users in accordance with Article 87(1) of the Treaty , or if that manager was chosen in a way which ensures that the amount of State support represents the market price to achieve the desired result.
