Un dépositaire ne peut exercer d’activités en ce qui concerne le FIA ou le gestionnaire pour le compte du FIA, qui seraient susceptibles d’engendrer des conflits d’intérêts entre le FIA, les investisseurs dudit FIA, le gestionnaire et le dépositaire lui-même, sauf si le dépositaire a séparé, sur le plan fonctionnel et hiérarchique, l’exécution de ses tâches de dépositaire et ses autres tâches qui pourraient s’avérer incompatibles et que les conflits d’intérêts potentiels sont identifiés, gérés, suivis et révélés aux investisseurs du FIA de manière appropriée.
A depositary shall not carry out activities with regard to the AIF or the AIFM on behalf of the AIF that may create conflicts of interest between the AIF, the investors in the AIF, the AIFM and itself, unless the depositary has functionally and hierarchically separated the performance of its depositary tasks from its other potentially conflicting tasks, and the potential conflicts of interest are properly identified, managed, monitored and disclosed to the investors of the AIF.
