Le présent accord sectoriel est une convention non contraignante (“Gentlemen's Agreement”) entre les Participants et constitue l'annexe III de l'Arrangement; il fait partie intégrante de l'Arrangement et succède à l'accord sectoriel en vigueur depuis juillet 2007.
This Sector Understanding is a Gentlemen's Agreement among its Participants and is Annex III to the Arrangement; it forms an integral part of the Arrangement and it succeeds the Sector Understanding which came into effect in July 2007.

The Arrangement is a Gentlemen's Agreement among the Participants; it is not an OECD Act (1), although it receives the administrative support of the OECD Secretariat (hereafter: “the Secretariat”).

First plea: Toshiba submits that the General Court applied the wrong legal test when considering that the Japanese manufacturers of power transformers were potential competitors on the EEA market (1) on the ground that barriers to entry on the EEA market were not insurmountable and (2) on the basis of the existence of the Gentlemen’s Agreement, instead it should have verified if the Japanese producers had real concrete possibilities to enter the EEA market and that such an entry was an economically viable strategy.

À défaut de concurrence potentielle entre les producteurs japonais et européens, le gentlemen’s agreement ne pouvait pas enfreindre l’article 81 CE et la Commission n’avait pas compétence pour engager des poursuites.
In the absence of potential competition between Japanese and European producers, the Gentlemen’s Agreement could not infringe Article 81 EC and the Commission lacked jurisdiction to pursue a case.

L’arrêt et la décision attaqués doivent donc être annulés dans la mesure où ils concluent que Toshiba a continué à participer au gentlemen’s agreement jusqu’au mois de mai 2003.
The Contested Judgment and Contested Decision should therefore be annulled in so far as they conclude that Toshiba continued to participate in the Gentlemen’s Agreement until May 2003.

Rejects the Council's suggestion that the fact that Parliament and the Council have not, in the past, scrutinised the implementation of their respective sections of the budget was the result of a ’Gentlemen's agreement’ (Resolution recorded in the minutes of the Council meeting of 22 April 1970); considers the Gentlemen's Agreement not to be a binding document, and the interpretation attributed to it by the Council to be exceedingly wide;
