The recent adoption by Council[9] of a mandate to authorise the Commission to negotiate an agreement for the legal framework with Azerbaijan and Turkmenistan for a Trans-Caspian gas pipeline system offers an immediate example of the benefits of EU-level action for energy security.

En ce qui concerne les dispositions relatives à l'importation et au lieu d'imposition des livraisons de gaz et d'électricité, il ressort d'une lecture littérale du texte de la directive 2006/112/CE que le régime spécial mis en place en vertu de la directive 2003/92/CE du Conseil du 7 octobre 2003 modifiant la directive 77/388/CEE en ce qui concerne les règles relatives au lieu de livraison du gaz et de l'électricité (4) ne s'applique pas aux importations et aux livraisons de gaz transporté par des gazoducs qui ne font pas partie du système de distribution, et en particulier ne s'applique pas aux gazoducs du système de transport via lesquels sont cependant réalisées de nombreuses opérations transfrontalières par gazoducs.
Regarding the provisions on imports and the place where the supply of gas and electricity is taxed, the text of Directive 2006/112/EC, taken literally, means that the special scheme set up under Council Directive 2003/92/EC of 7 October 2003 amending Directive 77/388/EEC as regards the rules on the place of supply of gas and electricity (4) does not apply to imports or supplies of gas transported through pipelines that are not part of the distribution system, and in particular, does not apply to the pipelines of the transmission system by which a large number of cross-border transactions through pipelines are nevertheless carried out.

Enfin, et pour répondre aux préoccupations exprimées concernant le champ d'application couvert selon le libellé proposé, le rapporteur suggère de préciser que le transport par navire devrait se faire "de gazoduc à gazoduc". Le Conseil devrait saisir cette occasion pour supprimer toute ambiguïté dans le texte final.
The rapporteur draws the legislator's attention to the fact that the simple replacement in Articles 38 and 39 of the VAT Directive of the term "supply of gas through the natural gas distribution system" by the term "supply of gas by pipeline or by vessel for transporting natural gas" does not take away completely the ambiguity of the text. Furthermore, although the terms in the relevant provisions change, the title of Section IV of Chapter 1 of Title V, where these provisions are included, remains unchanged ("Supply of goods through distribution systems"). Finally, and in order to respond to concerns expressed about the coverage under the proposed wording, the rapporteur proposes to specify that trasnsport by vessel should be "from pipeline to pipeline".
