Stresses the importance of the investment plan drawn up by the Commission because it is the first step in balancing the insufficient volume of public and private investment in the Union, which poses a serious risk to attaining the targets set by the Europe 2020 strategy; stresses that the fall in investments that followed the economic crisis has been particularly marked in the least wealthy regions; recalls, however, that the Juncker plan represents only EUR 315 billion in potential investments over three years while, according to the Commission, the European Union has an investment gap of at least EUR 300 billion per year; insists, therefore, on the need to restore additional room for manoeuvre for investment in the EU budget and in Member States’ budgets; stresses, that projects guaranteed by the European Fund for Strategic Investments (EFSI) should contribute to meeting EU policy objectives, comply with the objectives of cohesion policy as defined in Article 174 TFEU and respect the principles of additionality, economic viability and sound financial management; recalls, in this regard, that Member States’ financial contributions in the form of one-off measures to the EFSI to support dedicated investment platforms and national promotional banks and which benefit from the EU guarantee are covered by the full range of the existing rules of the Stability and Growth Pact;

La Commission estime qu'il est conforme à ses orientations relatives aux aides d'État en faveur des banques en situation de crise (voir IP/08/1945) et aux adaptations récemment apportées aux règles sur les garanties d’État, adoptées le 18 mai 2010 par le Conseil «Affaires économiques et financières» sur la suppression progressive des mesures d’aide au secteur financier.
The Commission considers the scheme to be in line with its guidance on state aid to banks during the crisis (see IP/08/1945) and the recent adjustment of the rules for state guarantees, endorsed by the 18 May 2010 EU Council of Economic and Financial Affairs Ministers on the phasing out of support measures for the financial sector.

Une solution partielle semble toutefois être apportée par la proposition de directive concernant les garanties financières (voir IP/01/464 et MEMO/01/108), qui s'inscrit dans le cadre des travaux en cours à la Conférence de La Haye sur le droit international privé.
On the other hand, the removal of barriers related to taxation and legal certainty is clearly the responsibility of the public sector. Although many tax-related barriers would lose relevance if investors were free to hold their securities within their chosen taxation regime, there remains a convincing argument in favour of harmonising the procedures for securities taxation as a further means to facilitate the integration of EU financial markets. Barriers related to legal certainty reflect more fundamental differences in the concepts of underlying national laws and would appear more difficult to remove than barriers in the other categories. Nevertheless, a partial solution seems to be available in the proposed EU Directive on collateral management (see IP/01/464 and MEMO/01/108), which is reflected by work currently underway at the Hague conference on private international law.

IV. 2.8 Garanties financières apportées par les entreprises Pour apporter la preuve de la capacité financière et économique d'une entreprise, la Commission a estimé qu'exiger des références bancaires provenant d'une institution de crédit établie sur le territoire de l'Etat membre du pouvoir adjudicateur, était contraire aux dispositions et à l'esprit des directives marchés publics ainsi qu'à l'article 59 du Traité CEE.
IV. 2.8 Financial guarantees provided by contractors When it comes to furnishing evidence of a contractor's financial and economic standing, the Commission took the view that requiring bank references from a credit institution established in the Member State of the contracting authority was in breach of the letter and spirit of the procurement directives and of Article 59 of the Treaty.
