2. The Member States of the European Union are called upon to establish a European platform consisting of representatives of the national bodies that are responsible for monitoring Member States’ performance in complying with fundamental and citizens’ rights in order to scrutinise the consistency of national laws
on the intelligence services with the ECHR and the EU Charter of Fundamental Rights, to review the legal provisions guaranteeing postal and communications secrecy, and, in addition, to reach agreement on a recommendation to the Member States on a Code of Conduct t
o be drawn up which guarantees ...[+++] all European citizens, throughout the territory of the Member States, protection of privacy as defined in Article 7 of the Charter of Fundamental Rights of the European Union and which, moreover, guarantees that the activities of intelligence services are carried out in a manner consistent with fundamental rights, in keeping with the conditions set out in Chapter 8 of this report, and in particular Section 8.3.4., as derived from Article 8 of the ECHR.
