Les articles 4 à 7 de la présente directive ne s’appliquent à aucune restriction quant à l’exécution de contrats de garantie financière, à aucune restriction quant à l’effet d’un dispositif de garantie financière avec constitution de sûreté, à aucune clause de compensation avec ou sans déchéance du terme (netting ou set-off) qui est imposée en vertu du titre IV, chapitre IV ou V, de la directive 2014/59/UE du Parlement européen et du Conseil (*4), ni à aucune restriction qui est imposée en vertu de pouvoirs similaires selon le droit d’un État membre afin de faciliter la résolution ordonnée d’une entité visée au paragraphe 2, point c) iv) et point d), qui fait l’objet de garanties au moins équivalentes à celles qui sont énoncées au titre IV, chapitre VI, de la directive 2014/59/UE.
Articles 4 to 7 of this Directive shall not apply to any restriction on the enforcement of financial collateral arrangements or any restriction on the effect of a security financial collateral arrangement, any close out netting or set-off provision that is imposed by virtue of Title IV, Chapter V or VI of Directive 2014/59/EU of the European Parliament and of the Council (*4), or to any such restriction that is imposed by virtue of similar powers in the law of a Member State to facilitate the orderly resolution of any entity referred to in points (c)(iv) and (d) of paragraph 2 which is subject to safeguards at least equivalent to those set out in Title IV, Chapter VII of Directive 2014/59/EU.

3. The financial guarantee or equivalent insurance shall be established by the notifier or by another natural or legal person on its behalf and shall be effective at the time of the notification or, if the competent authority which approves the financial guarantee or equivalent insurance so allows, at the latest when the shipment starts, and shall apply to the notified shipment at the latest when the shipment starts.
