L’article 1er de la décision C(2007) 4441 final de la Commission, du 3 octobre 2007, relative à une procédure d’application de l’article 81 [CE] (affaire COMP/38.710 — Bitume Espagne), est annulé en tant qu’il constate l’implication de Galp Energía España, SA, de Petróleos de Portugal (Petrogal), SA, et de Galp Energia, SGPS, SA, dans un ensemble d’accords et de pratiques concertées sur le marché espagnol du bitume, dans la mesure où cet ensemble comprend, d’une part, le système de surveillance de la mise en œuvre des accords de partage du marché et de la clientèle et, d’autre part, le mécanisme de compensation destiné à rectifier les écarts survenus par rapport aux accords de répartition du marché et de la clientèle.
Annuls Article 1 of Commission Decision C(2007) 4441 final of 3 October 2007 relating to a proceeding under Article 81 [EC] (Case COMP/38.710 — Bitumen Spain) in so far as it finds that Galp Energía España, SA, Petróleos de Portugal (Petrogal), SA, and Galp Energia, SGPS, SA were involved in a complex of agreements and concerted practices in the Spanish market for bitumen, to the extent that that complex includes (i) the system for monitoring the implementation of the market sharing and customer-allocation arrangements and (ii) the compensation mechanism to correct deviations from the market-sharing and customer-allocation arrangements;

L’article 3 de la décision C(2007) 4441 final est annulé en tant qu’il oblige Galp Energía España, Petróleos de Portugal (Petrogal) et Galp Energia, SGPS à mettre fin à l’infraction telle que constatée à l’article 1er de ladite décision et à s’abstenir de répéter tout acte ou comportement visé à cet article ou ayant un objet ou un effet similaire, dans la mesure où cette infraction comprend, d’une part, le système de surveillance de la mise en œuvre des accords de partage du marché et de la clientèle et, d’autre part, le mécanisme de compensation destiné à rectifier les écarts survenus par rapport aux accords de répartition du marché et de la clientèle.
Annuls Article 3 of Decision C(2007) 4441 final in so far as it requires Galp Energía España, Petróleos de Portugal (Petrogal) and Galp Energia, SGPS to bring to an end the infringement as found in Article 1 of that decision and to refrain from repeating any act or conduct described in that article or having the same or similar object or effect, to the extent that that infringement includes (i) the system for monitoring the implementation of the market-sharing and customer-allocation arrangements and (ii) the compensation mechanism to correct deviations from the market-sharing and customer-allocation arrangements;
