souligne qu'il est important d'établir des relations constructives et mutuellement avantageuses entre l'UE et la Russie dans le domaine du transport; regrette que la question des paiements pour le survol de la Sibérie continue de faire obstacle à l'établissement de telles relations; rappelle sa vive préoccupation concernant le système de paiements auquel doivent se soumettre les transporteurs européens pour pouvoir survoler le territoire russe et en particulier la Sibérie; estime que cette pratique est contraire aux obligations qui incombent à la Russie en vertu de la convention de Chicago et notamment de son article 15; réaffirme entre autres ses conclusions des 27 et 28 juin 2005, dans lesquelles il a souligné qu'il importait en priorité de parvenir à une solution satisfaisante concernant la suppression progressive de ces paiements; estime que parvenir à une telle solution constitue une condition préalable à l'adhésion de la Russie à l'OMC; rappelle l'engagement pris à cet égard par le gouvernement russe en mai 2004; charge la Commission de négocier avec le gouvernement russe un accord garantissant: la suppression complète des paiements d'ici au 31 décembre 2013 au plus tard; la réduction progressive des paiements au cours de la période de transition courant à partir de 2006; la fin des accords commerciaux obligatoires relatifs au survol du territoire de la Fédération de Russie d'ici à 2013 au plus tard; la suppression progressive des restrictions relatives au survol du territoire russe entre l'Europe et l'Asie, ainsi que l'élimination complète de toutes les restrictions à caractère non technique d'ici à 2013 au plus tard; considère que cet accord remplacera et annulera les dispositions correspondantes des accords bilatéraux entre les États membres et la Fédération de Russie dans le domaine de l'aviation, ainsi que celles des documents y afférents; exprime le souhait, moyennant un règlement satisfaisant de la question du survol, d'examiner avec la Fé ...
underlines the importance of developing a constructive and mutually beneficial relationship between the EU and Russia in the field of transport; regrets that the issue of Siberian overflight payments continues to be an obstacle to the development of such a relationship; reiterates its strong concerns with regard to the system of Siberian overflight payments made by EC carriers for the right to overfly Russian territory; considers that this practice is not in line with Russia's obligations under the Chicago Convention, and in particular Article 15 thereof; reaffirms inter alia its conclusions of 27/28 June 2005 in which it stressed the priority importance of reaching a satisfactory solution to the phasing out of these payments; considers reaching such a solution to be a prerequisite for Russia’s accession to WTO; recalls the commitment of the Russian government of May 2004 in this regard; mandates the Commission to negotiate an agreement with the Russian government assuring the complete abolition of payments at the latest by 31 December 2013; progressive reduction of payments during the transition period from 2006 onwards; the end of mandatory commercial agreements related to the overflight of the territory of the Russian Federation by 2013 at the latest; gradual removal of restrictions on overflights over Russian territory between Europe and Asia and complete elimination of all non-technical restrictions by 2013 at the latest. considers that such an agreement will supersede the relevant provisions in bilateral aviation agreements, including any related documents, between Member States and the Russian Federation; expresses the wish, on the basis of a successful resolution of the overflight issue, to examine with the Russian Federation the possibilities for further developing cooperation in the field of transport".

Outre les règles concernant la partie opérationnelle et les responsabilités des parties etc., le mémorandum prévoit certaines dispositions et conditions qui se révèlent nécessaires pour faire en sorte que les objectifs des programmes soient atteints et que le programme soit correctement mis en oeuvre : le gouvernement russe garantira la transparence et le contrôle intégral de toutes les opérations, depuis la prise en charge des produits jusqu'aux derniers points de distribution de ceux-ci, et préparera des rapports réguliers sur la mise en oeuvre du programme, rapports qui seront transmis à la Commission ; les produits inclus dans le programme seront vendus aux prix applicables sur le marché local dans les régions où il y a pénurie alimentaire ; les recettes des ventes seront imputées à un compte spécial ouvert et géré par le ministère des finances de la Fédération de Russie et destiné à des fins sociales ; le gouvernement russe garantira que les produits inclus dans le programme ne seront pas réexportés et qu'il n'exportera pas les mêmes produits ; les produits inclus dans le programme seront livrés à la Russie par tranches successives ; la Commission se réserve le droit de suspendre l'opération si des éléments sont portés à sa connaissance qui lui donnent des raisons de douter que les obligations du gouvernement de la Fédération de Russie, établies dans le mémorandum d'accord, soient pleinement respectées.
In addition to rules regarding the operational part and parties' responsibilities etc., the Memorandum includes certain provisions and conditions which will be required in order to ensure that the objectives of the programme are obtained and that it is correctly executed including that : The Russian Government will ensure transparency and full controls of all operations from the take-over of the commodities to the ultimate points of distribution of sales and will prepare regular reports on the implementation of the programme, which will be transmitted to the Commission. The products included in the programme will be sold at the prevailing local market prices in the regions where there are food shortages. The proceeds obtained from the sales will be placed on a special account opened and managed by the Ministry of Finance of the Russian Federation for social purposes. The Russian Government will ensure that the products included in the programme are not re-exported and that it will not export the same commodities. The products included in the programme will be delivered to Russia in several consignments. The Commission retains the right to suspend the operation if it receives evidence which gives it reason to doubt whether the obligations of the Government of the Russian Federation set out in the Memorandum of Understanding are being fully respected.
