The Commission considered however that, having consented to the division of the ownership of the trademark FYFFES in different Member States through a partial assignment in favour of Fyffes Plc, Chiquita would not be allowed under the Treaty rules on the free circulation of goods to rely on the trademark legislation of certain Member States to oppose the importation of bananas which have lawfully been marketed by Fyffes in another Member State.
