Le Tribunal a, ensuite, jugé, aux points 50 de ces arrêts, que c’était donc à tort que Freixenet soutenait que la chambre de recours avait méconnu cette disposition en ne l’invitant pas à présenter ses observations sur des faits notoires qu’elle ne pouvait ignorer et qui constituaient la position finale de l’OHMI ou sur lesdites illustrations des bouteilles.
The Court then held, at paragraph 50 of the judgments, that Freixenet was therefore wrong in claiming that the Board of Appeal had failed to comply with that provision by not inviting it to present its observations on well-known facts of which it could not have been unaware and which constituted the final position of OHIM or on the illustrations of the bottles.
