Par son pourvoi, la République française demande l’annulation de l’arrêt du Tribunal de première instance des Communautés européennes du 4 décembre 2008, People’s Mojahedin Organization of Iran/Conseil (T‑284/08, Rec. p. II‑3487, ci-après l’«arrêt attaqué»), par lequel celui-ci a accueilli le recours de la People’s Mojahedin Organization of Iran (ci-après la «PMOI») tendant à l’annulation de la décision 2008/583/CE du Conseil, du 15 juillet 2008, mettant en œuvre l’article 2, paragraphe 3, du règlement (CE) nº 2580/2001 concernant l’adoption de mesures restrictives spécifiques à l’encontre de certaines personnes et entités dans le cadre de la lutte contre le terrorisme, et abrogeant la décision 2007/868/CE (JO L 188, p. 21, ci-après la «décision litigieuse»), pour autant qu’elle concerne la PMOI.
By its appeal, the French Republic seeks to have set aside the judgment of the Court of First Instance of the European Communities of 4 December 2008 in Case T‑284/08 People’s Mojahedin Organisation of Iran v Council [2008] ECR I‑3487 (‘the judgment under appeal’), by which that court upheld the action brought by the People’s Mojahedin Organization of Iran (‘the PMOI’) for annulment of Council Decision 2008/583/EC of 15 July 2008 implementing Article 2(3) of Regulation (EC) No 2580/2001 on specific restrictive measures directed against certain persons and entities with a view to combating terrorism and repealing Decision 2007/868/EC (OJ 2008 L 188, p. 21, ‘the contested decision’), insofar as it concerned the PMOI.

La République française fait grief au Tribunal d’avoir jugé, au point 37 de l’arrêt attaqué, que la décision litigieuse a été adoptée en violation des principes relatifs aux droits de la défense dès lors que le Conseil a adopté cette décision sans avoir préalablement communiqué à la PMOI les nouvelles informations ou les nouveaux éléments du dossier qui, selon lui, justifiaient son maintien dans la liste visée à l’article 2, paragraphe 3, du règlement n° 2580/2001.
The French Republic complains that, at paragraph 37 of the judgment under appeal, the General Court held that the contested decision had been adopted in breach of the principles relating to the rights of the defence, inasmuch as the Council had adopted the decision without first informing the PMOI of the new information or new material in the file which, in its view, justified the continued inclusion of the PMOI in the list referred to in Article 2(3) of Regulation No 2580/2001.

Given that on 9 June 2008 the Council had received, from the French authorities, new information, namely, the judicial inquiry opened on 9 April 2001 in relation to 17 alleged members of the PMOI and the judicial investigation of 24 persons, warranting, according to those authorities, their request for the PMOI to be included in the list referred to in Article 2(3) of Regulation No 2580/2001, the Council ought, in order to guarantee the effectiveness of the sanctions, to have avoided any interruption of the freezing of funds and, therefore, to have adopted as swiftly as possible a new decision including the PMOI in that list.

La République française soutient que, lors de l’adoption de la décision litigieuse, il existait manifestement une menace d’interruption de la mesure de gel de fonds applicable à la PMOI et donc un risque de nuire à l’efficacité d’une telle mesure.
The French Republic maintains that, when the contested decision was adopted, there was clearly a threat that the fund-freezing measure applicable to the PMOI might be interrupted and, therefore, a danger that the effectiveness of the measure might be jeopardised.

Strongly welcomes the French initiative of a formal return to the military structures of NATO, and the efforts by the French Presidency within the EU Council to bring the EU and NATO further together in response to the new security challenges; welcomes the efforts of the French Presidency aimed at the adoption of concrete initiatives for the pooling of European defence capabilities; also welcomes the newly positive approach of the United States of America towards the consolidation of EU defence capabilities;
